Latin American bishop shares values on economy with European churches

Budapest – A common and differentiated way is needed to shift from cultures and economies of greed and de-limitation, to cultures and economies of sufficiency, the Rt Rev. Julio E. Murray, former President of the Latin American Council of Churches has told the 14th Assembly of the Conference of European Churches.Delivering the keynote speech at the Assembly in Budapest on Thursday, Murray, the Bishop of the Episcopal (Anglican) Church of Panama, said.”Witnessing to our Christian faith requires us to offer spiritual and practical resistance to economic injustice and ecological destruction and to do everything we can to promote an economy in the service of life,” he said.In his 30 minute speech, Bishop Julio urged a renewal of the ecumenical movement’s commitment to the poor and spoke from his context of Latin America to the delegates from across Europe.Bishop Murray expressed his fears for a global crisis in civilisation which had been driven by financial instability: “The neoliberal economic system have produced in the so-called third world countries a growing number of impoverished, marginalised and persecuted people.”When the global market is left to its own devises and desires, it has serious negative consequences, most noted the exclusion and exploitation of the majority of the world’s population.” In a strongly-worded critique of capitalist economic and fiscal policies Bishop Julio added: “The problem is with unfair rules designed by affluent governments to advance their own commercial interests.”During his keynote talk, the immediate past leader of CEC’s sister organisation in Latin America, Murray argued for an ‘economy of sufficiency’ rather than a “prosperity built on disproportionate and unjust debts..”We need – in a common and differentiated way – to shift from cultures and economies of greed and de-limitation, to cultures and economies of sufficiency.”The prophetic role of the Church, the time to take risks and the important role of the new generation were all raised as encouraging signs that CEC is responding to the challenge which is the theme of the Assembly: and now what are you waiting for? “To be part of the ecumenical movement is a declaration of our sure and certain hope for Gods gracious transformation of this world”, Bishop Julio added.Bishop Julio brought greetings from churches in Latin America to all the delegates and other participants at the CEC Assembly.

Parliament to launch in-depth inquiry into US surveillance programmes

Parliament’s Civil Liberties Committee will conduct an “in-depth inquiry” into the US surveillance programmes, including the bugging of EU premises and other spying allegations, and present its results by the end of this year, says a resolution passed by the full House on Thursday. The Parliament President and political group leaders formally confirmed the launch of the inquiry. MEPs also call for more protection for whistleblowers.In the resolution, approved by 483 votes to 98 with 65 abstentions, MEPs express serious concern over PRISM and other surveillance programmes, strongly condemn spying on EU representations and call on the US authorities to provide them with full information on these allegations without further delay.Parliament also expresses grave concern about allegations that similar surveillance programmes are run by several EU member states, such as the UK, Sweden, The Netherlands, Germany and Poland. It urges them to examine whether those programmes are compatible with EU law.The Civil Liberties Committee inquiry will gather information and evidence from both US and EU sources and present its conclusions in a resolution by the end of the year. It will assess the impact of the alleged surveillance activities on EU citizens’ right to privacy and data protection, freedom of expression, the presumption of innocence and the right to an effective remedy.MEPs involved in the inquiry will table recommendations to prevent similar cases in future and step up IT security in the EU institutions, bodies and agencies.MEPs stress the need for “procedures allowing whistleblowers to unveil serious violations of fundamental rights” and the importance of providing such people with the protection they need, including at international level.MEPs call on the European Commission, the Council of Ministers and EU countries to consider possible recourse to all levers at their disposal in negotiations with the US, including suspending the current air passenger and bank data deals (Passenger Name Record and Terrorist Finance Tracking Programme, respectively).EU data protection standards should not be undermined as a result of the EU-US trade deal, warns the resolution, adding that it would be “unfortunate” if EU-US trade talks were to be affected by such allegations.Parliament calls on EU countries to speed up their work on the whole data protection package and urges the Commission and the US authorities to resume negotiations on the data protection agreement without delay. The final deal must ensure that EU citizens’ access to the US judicial system is equal to that enjoyed by US citizens, it adds.

Cyber attacks: Parliament adopts stricter EU-wide penalties

Cyber criminals will face tougher penalties in the EU, under new rules adopted by Parliament on Thursday. The draft directive, already informally agreed with member states, also aims to facilitate prevention and to boost police and judicial cooperation in this field. In the event of a cyber attack, EU countries will have to respond to urgent requests for help within eight hours.The draft directive requires EU countries to set their maximum terms of imprisonment at not less than two years for the crimes of illegally accessing or interfering with information systems, illegally interfering with data, illegally intercepting communications or intentionally producing and selling tools used to commit these offences. “Minor” cases are excluded, but it is up to each country to determine what constitutes a “minor” case.The text sets up a penalty of at least three years’ imprisonment for using “botnets”, i.e. establishing remote control over a significant number of computers by infecting them with malicious software.Attacks against “critical infrastructure”, such as power plants, transport networks and government networks, can lead to a five-year prison sentence. The same applies if an attack is committed by a criminal organisation or if it causes serious damage. Member states will be required to respond quickly to urgent requests for help in the event of cyber attacks, so as to render police cooperation more effective. They will have to make better use of the existing 24/7 network of contact points to respond to urgent requests within eight hours. Legal persons, such as firms, would be liable for offences committed for their benefit (e.g. for hiring a hacker to get access to a competitor’s database). Penalties could include exclusion from entitlement to public benefits or closure of establishments.
The text, adopted by 541 votes to 91, with 9 abstentions, is expected to be formally adopted by the Council very shortly. The new directive builds on rules that have been in force since 2005. Once adopted, member states will have two years to transpose it into national law.

CEC Assembly opens with Gathering Service of worship

Prayers, scripture lessons and a sermon that began in Hungarian and ended in German were accompanied by hymns and intercessions in a multitude of languages. These were key elements of the opening service at the 14th Assembly of the Conference of European Churches (CEC) in Budapest. The “Gathering service” at the Hungarian Reformed Church on Pozsonyi Street, on the afternoon of Wednesday, July 3, marked the beginning of six days of decision-making during which delegates from nearly 120 Anglican, Baptist, Old Catholic and Orthodox churches will consider proposals for their common future in Europe. Representatives of committed ecumenical partners, including the Roman Catholic Church, were also present for opening prayer.The procession at the start of the service was led by some of the more youthful participants in the assembly, stewards from many churches who have volunteered to undertake some of the week’s most taxing work. They were followed by CEC officers and members of the Hungarian host committee.The sermon, on an incident in the life of the Apostle Paul recorded in Acts 22:14-16, was preached by Bishop József Steinbach, president of the Ecumenical Council of Churches in Hungary and bishop of the Trans-Danubian district of the Hungarian Reformed Church. His focus was on the theme of the CEC Assembly, taken from Acts: “And now, what are you waiting for?”Bishop Steinbach encouraged the assembly to approach the question first posed to Paul from three points of view: “from the point of view of the passage” itself, set in the past, but “then from the point of view of our changed world in which our churches serve; and finally from the point of view of where these two meet.” In this way, he explained, the question is no longer aimed solely at the apostle, but at our churches today, and at us as individual Christians: “What should we do? How should we proceed? How can we become witnesses to His will in this changed world, without delay?” For Europeans, and people throughout the contemporary world, another central question is: “How can we live together in peace” despite the modern problems that face us and the challenging diversity of our societies?Like Paul, Christians are called to bear witness to the good news of Jesus Christ. According to Steinbach, Christian witness should permeate society through believers’ loving service rather than through aggressive attempts at mission. Paul was “flexible, but only within certain limits”. His witness was marked by “determination and love” as well as “complete reliance upon the Lord”.At the same time, the bishop continued, Paul’s witness to the world of his time relied on “careful planning in order to be as efficient as possible”, and this provides direction for CEC and similar church bodies as they seek to transform their structures and strategies. He closed by asking for God’s blessing “so that we are able to hold discussions and come to decisions in the spirit of the Scripture’s message.”A hymn written for the Budapest Assembly by composer Peter Arendt of Denmark was premiered at the service and raised the question once again: “What are you waiting for? Is something stopping you? Called to be one, one in Christ! What are you waiting for?”
The Conference of European Churches (CEC) is a communion of 115 Orthodox, Protestant, Anglican and Old Catholic Churches from all European countries, and 40 associated organisations. It was founded in 1959 and the CEC has offices in Geneva, Brussels and Strasbourg.

Pagamenti delle pubbliche amministrazioni

La vera leva per rimettere in moto la crescita c’è già, basta azionarla. La chiave è anticipare al secondo semestre 2013 tutto il plafond di pagamenti delle pubbliche amministrazioni alle imprese spalmato attualmente fino al 2014. L’effetto shock che potrebbe derivarne “è un maggior gettito per lo Stato di 8-9 miliardi tra Iva e imposte dirette e contributi sociali”. Così Renato Brunetta, capogruppo del Pdl alla Camera dei deputati, in un’intervista a “Il Sole 24 Ore”.“Già solo per la quota prevista nel 2013 – sottolinea l’ex ministro – il governo ha stimato che dal pagamento dei debiti il Pil possa aumentare, nel 2013, dello 0,2 per cento. Se si anticipano anche i pagamenti della tranche originariamente prevista per il 2014 (altri 20 miliardi) il Pil potrebbe aumentare nel 2013 di ulteriori 0,3 punti, per un totale dello 0,5 per cento. Un aumento che produrrebbe effetti positivi sul gettito dei principali tributi: 4 miliardi sull’Iva, attraverso il riavvio del ciclo di fatturazione, 4-5 miliardi su tributi diretti e contributi sociali, per effetto della ripresa produttiva e occupazionale. Un impatto totale di 8-9 miliardi di euro, al netto di quanto già contabilizzato nei tendenziali”.“Non ci sono ostacoli a questa manovra. I pagamenti relativi a spese di parte corrente sono già computati nel calcolo del deficit. Solo le spese in conto capitale (investimenti) comportano un aumento dell’indebitamento netto, dello 0,5% nel 2013, comunque già concordato con l’Unione europea”.“Il ministro dell’Economia ha indicato settembre come data per avviare una possibile accelerazione? Sarebbe troppo tardi. Saccomanni – afferma il presidente dei deputati del Pdl – deve annunciare subito l’intenzione di anticipare i pagamenti nel 2013. È la mossa necessaria a migliorare le aspettative del sistema economico aumentando di conseguenza i consumi, con riflessi positivi anche sulla produzione. Gli interventi fin qui adottati su Imu, Iva, lavoro, sostegno al finanziamento delle imprese, sebbene di per sé positivi, sono tutti a rilascio lento, mentre la nostra proposta garantirebbe effetti immediati. E un ciclo virtuoso: riattivare subito il ciclo dei pagamenti dei propri fornitori; tornare a investire; ricominciare ad assumere”.“Nella mozione presentata nei giorni scorsi abbiamo chiesto che sia costituita una task force per monitorare l’attività delle singole amministrazioni coinvolte nella procedura relativa ai pagamenti. Serve maggiore coordinamento tra ministeri ed altre amministrazioni: bisogna lavorare pancia a terra, anche a luglio ed agosto, per fornire tutte le informazioni con il massimo della trasparenza. Propongo di inserire in una white list oppure in una black list chi adempie agli obblighi di pagamento e chi invece risulta ritardatario. La trasparenza, inoltre, avrebbe un notevole effetto indiretto. Se un’impresa viene pagata dalla Pubblica amministrazione, anche un suo fornitore può a sua volta avere gioco facile nel chiedere di essere saldato. Come in passato la ‘conventio a non pagare’ ha agito negativamente, allo stesso modo la nuova ‘conventio a pagare’ può innescare dinamiche positive”, conclude Brunetta.

Può essere condannato penalmente chi parcheggia l’autovettura davanti all’ingresso di un garage impedendo al proprietario di entrare o uscire con il proprio veicolo

L’automobilista indisciplinato può subire la reclusione per il reato di violenza privata (610 c.p.) che è integrato dall’uso di qualsiasi mezzo idoneo a privare coattivamente l’offeso della libertà di determinazione e di azione. Quante volte ci è capitato di trovare l’ingresso del box auto o della propria abitazione bloccato da un’altra autovettura, ma dopo la sentenza in questione della Suprema Corte, tutti quegli automobilisti a dir poco indisciplinati ci penseranno due volte prima di ripetersi perché possono essere condannati per il reato di “violenza privata” e rischiare sino a quattro anni di reclusione.In tal senso persuade ad evitare comportamenti del genere, spiega Giovanni D’Agata presidente e fondatore dello “Sportello dei Diritti”, la sentenza della quinta sezione penale della Corte di Cassazione 28487 del 2 luglio 2013, che ha preso in esame il caso di chi blocca l’ingresso al garage del proprietario – persona offesa impedendole di parcheggiarvi la sua auto. I giudici di Piazza Cavour sulla scia di precedenti per casi simili hanno rilevato che tale comportamento integra il reato di cui all’articolo 610 del Codice Penale in quanto la “violenza privata” si identifica in qualsiasi mezzo idoneo a privare coattivamente l’offeso della libertà di determinazione e di azione.Nella fattispecie, i giudici del Palazzaccio hanno rigettato il ricorso di un 60enne contro la condanna a 2 mesi e 15 giorni di reclusione e al risarcimento del danno da parte della Corte d’appello di Catanzaro, perché la corte di merito aveva riconosciuto la sussistenza del reato in quanto con più azioni esecutive di un medesimo disegno criminoso con violenza consistente nel parcheggiare la propria autovettura in modo tale da bloccare il passaggio alle autovetture in uscita e in entrata dal garage costringendo il proprietario a non poter parcheggiare.I giudici di legittimità rilevando la sussistenza degli estremi del reato per cui era stato prima imputato e poi condannato hanno ribadito il principio secondo cui: «Integra il delitto di violenza privata (articolo 610 Cp) la condotta di colui che parcheggia la propria autovettura in modo tale da bloccare il passaggio impedendo alla parte lesa di muoversi, considerato che ai fini della configurabilità del delitto in questione, il requisito della violenza si identifica in qualsiasi mezzo idoneo a privare coattivamente l’offeso della libertà di determinazione e di azione».Gli ermellini, hanno sottolineato come già con la sentenza 21779 del 2006 era stato condannato con un precedente analogo colui che aveva parcheggiato l’auto in maniera da ostruire l’ingresso al garage condominiale rifiutandosi di rimuoverla nonostante la richiesta della persona offesa.

Africa sub-sahariana: export e investimenti

In occasione dei Business Meeting annuali di SACE in Africa sub-sahariana, il gruppo assicurativo-finanziario italiano ha annunciato una pipeline di €250 milioni di nuovi progetti destinati a sostenere export e investimenti in quest’area caratterizzata da livelli di rischiosità elevati e da un potenziale di crescita notevole. “C’è una naturale convergenza tra quello che l’Italia ha da offrire e quello di cui l’Africa sub-sahariana ha bisogno per proseguire nel proprio cammino di sviluppo – ha spiegato Riccardo Fanelli, responsabile dell’ufficio di SACE a Johannesburg, che svolge le funzioni di hub per i mercati dell’Africa sub-sahariana –. Le imprese africane domandano tecnologie affidabili, dai macchinari agli apparecchi elettrici, dalle infrastrutture ai materiali da costruzione: tutti settori in cui le Pmi italiane eccellono. SACE è qui per valorizzare questo potenziale, mettendo a disposizione degli operatori economici un’ampia gamma di servizi assicurativo-finanziari necessari per far crescere il business in sicurezza”. Per rafforzare la propria capacità d’intervento in Africa sub-sahariana, SACE ha sviluppato una partnership di risk-sharing con l’Agenzia africana per lo sviluppo economico (ATI – African Trade Insurance Agency): avviata nel 2009, con l’acquisizione di US$10 milioni del capitale di ATI da parte di SACE, la cooperazione è stata ulteriormente rafforzata nel 2010 con l’entrata di SACE nel consiglio di amministrazione, e nel 2011, con l’attivazione di un desk permanente presso il quartier generale di ATI a Nairobi.
