Brussels, Today, the European Ferrous Recovery & Recycling Association EFR publishes the findings of its study on conflicting policies and initiatives up to, and including, the Steel Action Plan. Following the announcement by the EU Commission of a set of recommendations to revive the European steel industry in summer 2013, EFR commissioned France-based consultancy Laplace Conseil with the evaluation of the impact of those measures on the recycling industry.While fully supporting the Commission’s intention to foster a sustainable EU steel industry, EFR is nevertheless concerned that such measures, whilst ignoring current conflicting policies, might jeopardize the scrap collection, sorting and processing industry.“Export restrictions and high regulation costs on the EU scrap recycling industry will have a detrimental impact on EU’s employment, trade relations and environment,” warned EFR President Tom Bird. “Scrap collectors and processors, along with the EAF steel industry, enjoy a symbiotic relationship that needs to be nurtured, not put at risk by unintended consequences of new regulation.”The European scrap recycling industry provides economic as well as environmental benefits, employing 300.000 workers, and, together with the EAF sector, generating a trade surplus of 11 billion Euros. Compared to the BF/BOF sector, the EU’s EAF sector consumes 78% less energy and generates 85% less CO2. Proposals to restrict exports or impose additional monitoring burdens on scrap metal trade are particularly worrisome. Marcel Genet, Founder/Managing Director of Laplace Conseil and author of the report, comments: “The EU has a huge and growing scrap reservoir. There is no risk of scrap shortage that would justify export restrictions. Moreover, export restrictions will not increase domestic EAF steel industry output, since that is driven by domestic demand.”Basic Oxygen Furnace (BOF) and Electric Arc Furnace (EAF) producers are already facing very different regulatory costs, with the scrap-consuming EAF producers burdened with a higher regulatory cost per tonne of finished products. The EU scrap recycling industry fears that negative effects of existing regulations will remain unaddressed as policy makers turn to new scrap export restrictions, monitoring and regulations.

Seasonal workers from outside the EU will get better working and living conditions, including a minimum wage and proper accommodation, under a deal between Parliament and member states backed by civil liberties MEPs on Thursday. These rules, aimed at both ending exploitation and preventing temporary stays becoming permanent, are the first at EU level on seasonal work.“We finally have agreement on a directive that manages temporary, legal migration and ensures protection of workers from exploitation. It will be a strong tool to ensure humane conditions for low-wage workers, discourage undercutting and benefit good employers,” said Parliament’s rapporteur, Claude Moraes (S&D, UK).The Commission estimates put the number of seasonal workers who come to the EU each year from non-EU countries at over 100,000.

Warsaw The Australian Government’s plans to dismantle the current climate legislation could lead to it increasing emissions in 2020 rather than meeting its target of reducing them by 5% from 2000 levels, the Climate Action Tracker said today.As Prime Minister Tony Abbott introduced legislation into the Australian Parliament today, the Climate Action Tracker released a special briefing on what the repeals may mean, in scientific terms. The Climate Action Tracker has rated Australia’s current target of a 5 percent emissions reduction by 2020 at 2000 levels as “inadequate,” and consistent with a global pathway heading to temperature rises of 3.5-4˚C.However, by dismantling this legislation and replacing it with the Abbott Government’s proposed “Direct Action” plan, Australia instead looks set to increase its emissions by 12% in 2020.“Australia’s climate legislation was a milestone for the country and it had finally begun to turn a corner on climate change,” said Bill Hare, Director of Climate Analytics. “The legislation would have bent the relentless upward trend of its emissions curve downwards, moving Australia onto the first step toward a low carbon, climate-safe future, and created the governmental machinery needed for upgrading action.”“The proposed repeal will instead see a likely re-carbonisation of the power sector, the present machinery dismantled – and replaced by a climate policy that goes against the science.”

Les élections européennes des 22 au 25 mai 2014 suscitent d’ores et déjà des inquiétudes liées aux risques d’une forte abstention et de scores importants des partis «populistes ». Yves Bertoncini s’efforce de relativiser l’ampleur de ces deux défis politiques tout en appelant à les relever, dans une Tribune directement inspirée de son intervention lors d’une conférence organisée le 15 octobre à Paris par les Jeunes Européens de Sciences Po.Yves Bertoncini souligne tout d’abord qu’il est normal que des élections de nature subsidiaire suscitent un taux de participation limité, même s’il n’est pas exclu que le taux de participation aux prochaines élections européennes puisse être plus élevé qu’en 2009, compte tenu du nouveau contexte institutionnel et politique. Ce n’est pas seulement parce que le prochain président de la Commission devra être désigné en écho aux résultats des élections européennes que les citoyens pourraient voter davantage, mais surtout parce que nombre de débats nationaux ont été structurés par des enjeux européens au cours de la période récente.Yves Bertoncini indique par ailleurs qu’une poussée électorale populiste devrait intervenir au printemps prochain, qui serait la conséquence logique de crises économiques, sociales et politiques dépassant l’UE (au deux sens du terme). Mais il précise qu’il est douteux que cette poussée populiste ait beaucoup d’impact au Parlement européen, au sein duquel l’influence des forces politiques se mesure à l’aune du nombre de sièges obtenus, mais aussi de leur cohésion interne et de leur capacité à établir des coalitions majoritaires avec d’autres partis. C’est parce que les partis populistes sont structurellement faibles au regard de ces deux derniers critères que leur progression quantitative ne devrait pas altérer le fonctionnement du Parlement européen, au-delà de la présence plus nombreuse de voix discordantes dans l’hémicycle strasbourgeois.

La Cassazione conferma l’ammissibilità nel processo tributario del ricorso cumulativo

La Corte di Cassazione – Sesta Sezione Civile – con l’ordinanza n. 25129/13, depositata venerdì 08 novembre, ha confermato l’ammissibilità nel processo tributario del ricorso cumulativo nonché dell’appello cumulativo avverso più sentenze emesse tra le stesse parti, sulla base della medesima “ratio”, in procedimenti formalmente distinti ma attinenti al medesimo rapporto giuridico d’imposta, pur se riferiti a diverse annualità, ove i medesimi dipendano per intero dalla soluzione di una identica questione di diritto comune a tutte le cause, in ipotesi suscettibile di dar vita ad un giudicato rilevabile d’ufficio in tutte le cause relative al medesimo rapporto di imposta.
In sostanza, la Suprema Corte ha confermato la legittimità del ricorso cumulativo, che peraltro – ricorda Giovanni D’Agata, presidente dello “Sportello dei Diritti” – è stato utilizzato nelle cause relative agli estimi catastali contro l’Agenzia del Territorio di Lecce per tutti i contribuenti che si sono rivolti all’associazione coadiuvati dagli avvocati Maurizio Villani e Francesco D’Agata, nonostante le critiche di altre associazioni di categoria, che probabilmente non erano a conoscenza dell’orientamento giurisprudenziale della Cassazione sul punto della legittimità del ricorso cumulativo nonché dell’appello cumulativo.
