WJC Protests Swedish, Danish Doctors’ Assault on Circumcision

new yorkNEW YORK — The World Jewish Congress today strongly protested calls by Swedish and Danish medical associations for a ban on religious male circumcision.“The recommendation of the two medical associations is an insulting and intrusive assault on religious freedom,” said WJC CEO Robert Singer. “Religious circumcision, a procedure that has been practiced safely for millennia, confers notable health benefits. It is a bulwark against urinary-tract infections, cervical cancer and HIV-AIDS, which is why it is being promoted heavily by medical authorities in Africa and other places. Given the compelling religious freedom and health reasons for religious circumcision, the Swedish and Danish medical associations need to recognize that their call for a ban represents an appeal to xenophobia and ignorance and not enlightened science.” According to the Jewish Telegraphic Agency, the ethics council of the Sweden Medical Association, the union representing of 85% of the country’s physicians, last week recommended setting 12 as the minimum age for the circumcision and requiring the boy’s consent. The 3,000-member Danish College of General Practitioners contended in a statement that non-medical circumcision of boys amounts to abuse and mutilation, according to news reports.Jews perform religious circumcision, or brit milah, eight days after birth, while Muslims generally circumcise boys before age 10 The American Academy of Pediatrics stated in 2012 that the “preventive health benefits of elective circumcision of male newborns outweigh the risks of the procedure” and that “benefits include a significant reduction of urinary tract infections in the first year of life and, subsequently, in the risk of heterosexual acquisition of HIV and in the transmission of other sexually transmitted infections.” Moreover, the Academy declared, “Parents ultimately should decide whether circumcision is in the best interests of their male child.”

World Bank loan assists FYR Macedonia in better access to skills, knowledge, and technology

World_BankWASHINGTON The World Bank Board of Directors today approved the Skills Development and Innovation Support Project of US$24 million for FYR Macedonia. The Project aims to improve transparency of resource allocation and promote accountability in higher education, enhance the relevance of secondary technical vocational education, and support innovation capacity in FYR Macedonia.“Improving the country’s labor market performance and economic competitiveness will require a more skilled and better educated labor force, as well as increased technology absorption, and diffusion of knowledge and innovation,” explains Tatiana Proskuryakova, World Bank Country Manager for FYR Macedonia. “At the same time, the regulatory, institutional, and financial environment can be strengthened to further promote innovation at the firm level and to improve the commercial application of its academic science and technology assets.”The Project will benefit around 24,000 students and 1,500 teaching and management staff from technical vocational education and training institutions who would receive a new curriculum and practical training facilities, as well as training on management, planning, and process improvement. Students and staff of universities, research institutions, and enterprises will benefit from the implementation of quality assurance mechanisms and financing reform in higher education, and also from grants promoting R&D and innovation.“The project is designed to foster education and skills relevant to the job market, and enhance the country’s innovation capacity,” says Bojana Naceva, Senior Education Specialist in the World Bank’s Europe and Central Asia region and Task Team Leader of the project. “The activities of the firms in Macedonia oriented towards employing a skilled workforce and utilizing innovation are an important source of economic growth and generate related positive externalities, such as social inclusion and shared prosperity.”The Skills Development and Innovation Support Loan is issued by the International Bank for Reconstruction and Development (IBRD), and will cover US$24 million with an 18-year bullet maturity and 5-year grace period.

“The federal investments we make in scientific R&D at our nation’s excellent universities and the cutting edge innovations that our companies are able to scale-up, produce and market benefit us all. We urge the president and leaders from both parties in Congress to cooperatively work together to enact policies that will deliver the sustainable economic growth that is so vital to our country’s future.”
“In the past two years, President Obama has emphasized the need to stimulate American manufacturing to create jobs and a downstream delta of prosperity for communities across our nation. Tonight he said again, that we need the right fit of new training for jobs that our companies currently have open — and want to fill.”“As the president of the world’s largest scientific society with over 163,000 members and as a scientist raised in a family of educators, I can assure you that the focus on STEM education is correct. This is where the opportunities lie for the future of our nation, but we need to sharpen our pencil.”“Furthermore, to realize the innovation economy our nation’s leaders envision, there are several key policies still pending on the congressional agenda that, if enacted, will help provide components additive to our nation’s economic growth. They are:
Science and Technology Investment through the FY 2015 Budget: Science and technology are the economic workhorses that pull our nation forward, and over decades, they have driven the creation of countless high-skill, high-wage jobs and can once again propel a vigorous U.S. economy and a prosperous way of life for our citizens. The president and Congress should take advantage of the opportunity presented by the return to regular order and bipartisan cooperation in budgeting to establish a predictable and sustained investment strategy focused on research and science, technology, engineering and math (STEM) education funding at the National Science Foundation, the National Institutes of Health, the Department of Energy’s Office of Science, the National Institute for Standards and Technology and other key agencies. America COMPETES Act: Originally passed in 2007 and reauthorized in 2010, the legislation has helped support the science, technology and innovation enterprise that underpins U.S. economic growth and job creation. COMPETES has authorized critical funding for basic scientific research through the federal agencies, fueling America’s research universities, developing discoveries and technological advances and leading to important new innovations. COMPETES has also provided the means to strengthen a wide range of science, technology, engineering and math (STEM) education programs at all levels, from K 12 through graduate education. Sustained and predictable support for science, engineering and technology is essential for a healthy U.S. economy. It is important that Congress reauthorize COMPETES as soon as possible.
The Research and Development Tax Credit: The R&D tax credit is a crucial incentive for innovation, particularly in connection with fostering new technologies and expanding high-value manufacturing. Originally introduced in the Economic Recovery Tax Act of 1981, the credit has been allowed to expire eight times and has been extended 14 times. The current extension expired on December 31, 2013. A tax credit that is unpredictable is not nearly as beneficial in stimulating the economy. Most other nations have a permanent R&D tax credit; ACS believes strongly that the U.S. needs a permanent R&D tax credit in order to be globally competitive
The Energy Savings and Industrial Competitiveness Act of 2013: popularly known as the Shaheen-Portman bill, this legislation would rewrite national building codes – voluntary standards that are generally used by states and municipalities – with the aim of fostering great energy savings. The bill would also establish education programs to train workers in energy-efficient building design and installation of energy-efficient products and technologies. The bill provides incentives for using highly efficient motors, transformers, and sets goals for the federal government – the single largest consumer of energy. The Elementary and Secondary Education Act: Last reauthorized in 2001, ESEA or No Child Left Behind funds K-12 education and established standards of learning to shorten achievement gaps and promote equal access to education in the U.S. The ACS strongly encourages effective policies to promote STEM education as a national priority within the ESEA. We urge the Administration to work together with Congress in a bipartisan effort to ensure programs like the Math and Science Partnership retain funding to support teacher recruitment and retention efforts, inquiry based curriculum and definitions of critical subject areas for our future workforce.

WJC Expresses Outrage at Anti-Semitic Incident in Rome

ronaldlauderfrance-020613NEW YORK—The World Jewish Congress today expressed outrage at the anti-Semitic vandalism visited this past weekend on Roman Jewish institutions. Boxes containing severed pigs heads were sent to the Israel embassy in Rome and the city’s main synagogue, and anti-Semitic graffiti appeared on at least one building, even as the city was preparing to observe International Holocaust Remembrance Day today.
“This disgusting and cowardly act shows that the evils of anti-Semitism remain alive in the heart of Western Europe,” said WJC President Ronald S. Lauder. “We are gratified by the outpouring of support for Rome’s Jewish community from Mayor Ignazio Marino and others and the determination of Roman authorities to investigate the incident.”

Stop Equitalia! In caso fermo amministrativo illegittimo perché relativo a tributi prescritti deve pagare i danni per lite temeraria al cittadino che si trova l’auto bloccata dalle ganasce fiscali

Risarcita in via equitativa l’insegnante che a causa dell’erroneo provvedimento risulta avere difficoltà per raggiungere il posto di lavoro. Per la responsabilità aggravata è sufficiente provare la scarsa prudenza dell’esattore e non il dolo o la colpa grave È proprio il caso di dirlo: un brutto, ennesimo stop per Equitalia viene dalla sentenza n. 182 del 23 dicembre 2013 della Commissione Tributaria Provinciale di Campobasso che ha ritenuto giusto condannare per lite temeraria l’esattore, ordinando il risarcimento in via equitativa ad un contribuente cui era stato emesso un provvedimento di fermo amministrativo illegittimo perché relativo a crediti prescritti.
Nel caso di specie, rileva Giovanni D’Agata, presidente dello “Sportello dei Diritti”, i giudici tributari hanno accolto il ricorso di un’insegnante che era stata messa in difficoltà a raggiungere il posto di lavoro a seguito del blocco fiscale della sua automobile a causa del mancato pagamento di alcune cartelle per crediti Inps nonostante tale richiesta fosse ormai prescritta, essendo decorsi, addirittura, oltre dieci anni.
La corte molisana ha quindi disposto l’annullamento dell’atto impositivo e ha anche concesso il risarcimento dei danni subiti a causa delle difficoltà conseguenti al mancato uso della propria automobile rilevando che ai fini della sussistenza della responsabilità per lite temeraria, stabilita dall’articolo 96 del Codice di Procedura Civile, dell’agente della riscossione che esegua il fermo di un autoveicolo per un credito tributario già prescritto, non si richiede né il dolo né la colpa grave, ma trattandosi di misura cautelare è sufficiente il difetto della normale prudenza, agevolmente configurabile nell’ipotesi in cui la prescrizione sia rilevabile dallo stesso provvedimento notificato al contribuente.
Ma v’è di più, per i giudici, la liquidazione del danno da lite temeraria può essere effettuata secondo equità dal giudice (anche tributario) poiché è costituito non già dalla lesione della posizione materiale della parte vittoriosa, ma dagli oneri di ogni genere che essa abbia dovuto affrontare per essere stata costretta a contrastare l’ingiustificata pretesa della parte avversa e dai disagi sopportati per effetto di quella iniziativa, danni desumibili dalla comune esperienza. Nella fattispecie, l’agente per la riscossione è stato condannato, quindi, non solo al pagamento delle spese processuali, ma anche a versare 500 euro extra.

Devono essere risarciti dall’ente autostradale i danni subiti dall’autovettura a causa della gomma abbandonata sull’asfalto

autostradeI pedaggi autostradali aumentano e nonostante ciò i gestori cercano di farla franca anche dalle proprie responsabilità. Ma per la giustizia, non si può sottrarre alla propria responsabilità la concessionaria che gestisce l’autostrada quando accade un sinistro cagionato da un ostacolo al centro della carreggiata e non segnalato dai pannelli luminosi in esercizio lungo il tracciato.
In tali casi, come sovente afferma la giurisprudenza e come viene confermato dalla sentenza 16/2013, pubblicata dal giudice di pace di Santhià (Vercelli) che Giovanni D’Agata, presidente dello “Sportello dei Diritti”, ritiene opportuno diffondere, la società proprietaria o custode dell’infrastruttura ha l’obbligo di risarcire i danni patrimoniali subiti dall’autovettura che era entrata in collisione con un grosso pneumatico di camion che si trovava sulla strada.
Nel caso di specie, il magistrato onorario ha ritenuto fondata la richiesta di risarcimento di un automobilista cui sono stati liquidati circa 4.500 euro per i danni subiti dalla propria autovettura, nonché le spese di giudizio, a seguito dello scontro contro lo pneumatico di un autoarticolato abbandonato sull’asfalto e che era apparso all’improvviso innanzi al proprio veicolo mentre percorreva nella prima mattinata il tratto stradale in cui era competente il giudice di pace adito.Il vero e proprio ostacolo risultava quindi «non visibile né prevedibile» perché non segnalato con un avviso di pericolo, ed è quindi certamente configurabile la responsabilità stabilita dall’articolo 2051 del Codice civile a carico dell’ente custode della strada perché lo scontro risulta comunque cagionato da un’omissione di vigilanza di chi gestisce l’infrastruttura.
Peraltro, nel corso dell’istruttoria un assistente al traffico sentito come testimone ha confermato che al call center dell’ente era giunta una segnalazione che aveva avvisato circa la presenza dell’ostacolo in piena carreggiata, ma prima dell’orario in cui si è verificato il sinistro.Né può essere invocata da parte della convenuta società la circostanza che il mezzo di servizio e soccorso si trovasse a cinquanta chilometri dal luogo del sinistro: in attesa che la squadra giungesse sul posto sarebbe stato opportuno avvisare dell’ostacolo le auto in transito mediante i pannelli ad hoc che veicolano (ad esempio) i messaggi con i limiti di velocità, la presenza del tutor o gli eventuali incidenti sul tracciato. Va, inoltre, esclusa la sussistenza del caso fortuito che scriminerebbe il custode dell’infrastruttura.
