European Parliament gives a green light to cooperation agreement between Denmark and Europol

DanimarcaA broad majority of MEPs on Thursday backed the proposal to establish an operational and strategic cooperation agreement between Denmark and Europol. Parliament backed the cooperation agreement with 569 votes to 8, with 62 abstentions.
“The fight against cross-border crime and terrorism necessitates close cooperation among EU member states. A sudden departure of Denmark from Europol could lead to operational gaps and reduce the EU’s capacity to fight organised crime and terrorism. It is therefore important that we ensure a sufficient level of cooperation with Denmark after 1st of May”, said lead MEP Agustín Díaz de Mera (EPP, ES).
In it’s resolution Parliament notes the exceptional nature of the foreseen arrangement between Europol and Denmark and repeats that MEPs would have liked to see “an expiry date of five years” in order to ensure its transitional nature “with a view to a more permanent arrangement”.In line with the joint declaration from the President of the European Council, the President of the European Commission and the Prime Minister of Denmark, MEPs also stress that the agreement is conditional on Denmark’s continued membership of the Union and of the Schengen area, Denmark’s obligation to fully implement in Danish law the directive on data protection in police matters by 1 May 2017 and Denmark’s agreement to the application of the jurisdiction of the EU Court of Justice and the competence of the European Data Protection Supervisor.
The European Parliament needs to be consulted before the agreement can enter into force.
Background. The cooperation agreement aims to minimise the negative impact of Denmark’s departure from Europol on 1 May 2017, following the Danish referendum on 3 Dec. 2015, and avoid creating gaps in the joint fight against serious crime and terrorism.
On 15 December 2016 the President of the European Council, the President of the European Commission and Denmark’s Prime Minister Lars Løkke Rasmussen issued a joint declaration proposing to associate Denmark to Europol in the form of a cooperation agreement.
Establishing this cooperation agreement has entailed two legislative steps: firstly, Denmark was added to the list of third countries with whom Europol can conclude cooperation agreements, secondly the cooperation agreement itself.
On 14 February 2017, the Plenary backed adding Denmark to the list of third countries with an overwhelming majority of 632 votes to 10, and 51 abstentions.

Organised crime: Europol threat assessment debated by Civil Liberties MEPs

europolCivil Liberties MEPs debated Europol’s report on serious and organised crime with Europol director Rob Wainwright. Europol’s director Rob Wainwright presented the report on ‘Serious and Organised Crime Threat Assessment, SOCTA, 2017 to Civil Liberties MEPs on Monday afternoon. The report identifies a number of threats affecting the internal security of the European Union, such as document fraud, money laundering and online trade in illicit goods and services, and gives recommendations to the Council of Justice and Home Affairs Ministers on priorities for the coming four years 2017 – 2021. According to Europol’s analysis, 5.000 criminal networks operate in Europe with people from more than 180 nationalities. The groups are diverse, flexible and can adapt easily to new environments. Drug trafficking counts as the largest criminal market, but also cybercrime, migrant smuggling, trafficking in human beings and organised property crime, are identified as serious threats and should be priorities for the future fight against organised crime, the report says.The exploitation of the rapid technological developments, such as the use of social media and the dark net, smuggling of unaccompanied minors, fraudulent ID-cards, and whether existing tools to fight cross border crime are sufficient, were among the topics raised by MEPs in the debate. In a separate debate following the SOCTA presentation, MEPs discussed the fight against cybercrime with experts from Europol’s Cybercrime Centre, Eurojust, civil society and data protection experts.

Denmark-Europol: Parliament passes first step towards the establishment of a cooperation agreement

europolDenmark should be added to the list of countries with which Europol can conclude operational cooperation agreements, the European Parliament recommended on Tuesday. However, MEPs also call on Council to set a sunset clause on a future agreement.Parliament passed the draft report by Agustín Díaz de Mera García Consuegra (EPP, ES) by 632 votes to 10, with 51 abstentions.”It is vital to keep Denmark in Europol for the security of all Europeans, nor will the Danish people be completely secure without Europol”, said Agustín Díaz de Mera García Consuegra. Adding Denmark to the list of countries with which Europol can conclude cooperation agreements (Decision 2009/935/JHA) constitutes a first step towards setting up an operational cooperation agreement between Denmark and Europol so as to minimise the negative impact of Denmark’s departure from Europol on 1 May 2017, following the Danish referendum on 3 December 2015.However, MEPs also call on the Council to provide “for an expiry date of five years after the date of entry into force” of the agreement.
Including a sunset clause in the agreement should “ensure its transitional nature with a view to full membership or the conclusion of an international agreement in accordance with Article 2018 TFEU” MEPs add.
When Denmark has been added to the list of countries with which Europol can conclude cooperation agreements, Council will need to consult Parliament on establishing the concrete cooperation agreement between Europol and Denmark. Parliament has no formal say on adding Denmark to the list and establishing a cooperation agreement, but it needs to be consulted on both issues before an agreement can be concluded.

Europol: Democratic oversight and EU internal security policies

europolMembers from national parliaments and the Civil Liberties Committee will meet on Monday from 15.00 to 18.30 to discuss the framework of EU internal security policies and the democratic oversight and scrutiny of Europol’s activities. Among others Julian King, Commissioner of Security Union, and Rob Wainwright, director of Europol, will be on the panel. They will also debate how to make the security union a reality and discuss best practices of parliamentary scrutiny at national level.The interparliamentary committee meeting is a follow-up to the new Europol Regulation that entered into force on 11 May 2016. One of its innovative features is the setting up of a Joint Parliamentary Scrutiny Group to ensure proper democratic scrutiny of Europol’s activities by the European Parliament, together with national parliaments. Ensuring the democratic oversight of Europol was a high priority for the Parliament when approving the new regulation.MEPs and representatives from national parliaments will work towards defining the modalities of the scrutiny body so that it is ready by 1 May 2017, when the new Europol Regulation takes effect. The meeting will be split into two sessions, each followed by debates with MEPs and national parliaments. The first session is entitled “Setting the scene – making the Security Union a reality and the role of Europol therein: operational cooperation, information sharing and trust” (15.10 – 16.30) and the second session will be “Towards an effective and workable parliamentary scrutiny of Europol” (16.30 – 18.30).The new Europol Regulation strengthened the EU police agency’s mandate in order to ensure that it is fully equipped to fight terrorism, cybercrime and the rise in cross-border crimes. In particular, it is now easier to set up specialized units to respond immediately to emerging threats. The Joint Parliamentary Scrutiny Group will oversee this work.

EUROPOL: New rules to step up EU police cooperation and fight terrorism

europolThe EU police agency EUROPOL will soon be able to step up efforts to fight terrorism, cybercrime and other criminal offences and respond faster to threats, thanks to new governance rules up for final approval by Parliament on Wednesday 11 May in Strasbourg. The new powers come with strong data protection safeguards and democratic oversight tools. The draft rules, agreed by Parliament and Council negotiators in November last year, will enhance EUROPOL’s mandate to ensure that it is fully equipped to counter the rise in cross-border crimes and terrorist threats, in particular by making it easier for EUROPOL to set up specialised units to respond immediately to emerging threats.

Terrorismo: voto finale sui nuovi poteri a Europol

europolStrasburgo 12 maggio Parlamento europeo. L’agenzia di polizia europea Europol sarà presto in grado di intensificare gli sforzi per combattere il terrorismo, la criminalità informatica e altri reati e rispondere più rapidamente alle minacce, grazie alle nuove regole di governance che saranno votate mercoledì. Con i nuovi poteri arrivano anche forti garanzie sulla protezione dei dati e strumenti di controllo democratico.
Il progetto di regolamento, approvato dal Parlamento e dal Consiglio nel novembre dello scorso anno, potenzierà il mandato di Europol volto a garantirne la piena operatività nel contrastare l’aumento dei crimini transfrontalieri e le minacce terroristiche. In particolare, sarà più facile per Europol istituire unità specializzate per rispondere immediatamente alle minacce emergenti.

Europol e gli allarmi. A cosa servono?

europolL’Europol, lancia l’allarme attentati terroristici nel corso di una audizione davanti al Comitato Schenghen. L’Europol e’ l’Ufficio europeo di polizia che si occupa della applicazione delle leggi europee. Ci chiediamo a cosa serve pubblicizzare tale notizia. “Siamo molto preoccupati per la possibile connessione tra reti terroristiche e trafficanti di migranti” ha detto il direttore di Europol, Rob Wainwright. Che ci siano connessioni tra terroristi e migranti non e’ un grande segreto, quello che sarebbe necessario fare e’ impedire connessioni e relativi attentati. In questo senso, sarebbe utile colmare le lacune di informazioni, e di collegamento, che i recenti attentati hanno evidenziato. E’ stato fatto o ciascuna polizia, e ogni servizio segreto, degli Stati europei continua a lavorare autonomamente senza mettere insieme forze e informazioni? Divulgare allarmi, per quanto giustificati siano, serve solo a mettere in ansia i cittadini e indurli a modificare le proprie abitudini di vita. F-Secure ed Europol uniscono le forze per combattere il crimine informatico

europolF-Secure ha sottoscritto un Memorandum of Understanding (MoU) con il Centro Europeo per il Cybercrimine di Europol (EC3) che consentirà una cooperazione avanzata nella lotta contro il crescente problema del crimine informatico. Il MoU viene siglato oggi presso l’headquarter di Europol all’Aia.
Affrontare le sfide odierne alla sicurezza digitale richiede un approccio collettivo in cui le forze dell’ordine e l’industria privata devono lavorare insieme in modo più stretto. In un panorama della sicurezza così complesso, simili partnership stanno diventando sempre più importanti, specialmente a causa della rapidità con cui la tecnologia continua a evolvere. In particolare, questo MoU consentirà uno scambio tra le due parti di esperienze, statistiche e informazioni strategiche sulle minacce informatiche.
Kimmo Kasslin, Capo dei Laboratori di F-Secure ha dichiarato: “La nostra missione è proteggere le persone e le aziende dalle minacce informatiche, e la cooperazione con le forze dell’ordine è una parte importante di questa missione. Siamo entusiasti di poter offrire la nostra intelligence delle minacce a Europol per aiutarli nei loro sforzi investigativi e di applicazione dell’ordine nel rendere il mondo online un posto più sicuro per tutti.”
Steven Wilson, Capo dell’European Cybercrime Centre (EC3) di Europol ha sottolineato: “La firma di questo memorandum d’intesa tra Europol e F-Secure migliorerà le nostre capacità e aumenterà la nostra efficacia nell’assistere le forze dell’ordine in Europa nel prevenire, perseguire e far cessare la criminalità informatica. Europol: MEPs endorse new powers to step up EU police counter-terrorism drive

europolThe EU police agency Europol will soon be able to step up efforts to fight terrorism, cybercrime and other criminal offences and respond faster, thanks to new governance rules endorsed by Civil Liberties Committee MEPs on Thursday. The new powers come with strong data protection safeguards and democratic oversight.
The draft rules, agreed by Parliament and Council in November last year and approved by 40 votes to 3, with 2 abstentions by the Civil Liberties Committee on Thursday, will enhance Europol’s mandate to ensure that it is fully equipped to counter the rise in cross-border crimes and terrorist threats, in particular by making it easier for Europol to set up specialised units to respond immediately to emerging threats.

The Civil Liberties Committee vote paves the way for the final approval of the new rules by Parliament as a whole in Strasbourg early in May. The new rules will take effect on 1 April 2017.

MEPs give green light to Europol-Brazil deal to fight crime and terrorism

san paolo brasileA new cooperation agreement between the European Police Office (Europol) and Brazil to crack down on organised crime and terrorism was backed by Parliament on Tuesday. Europol says that Brazil is increasingly relevant in the fight against organised crime, including illegal immigration and trafficking in human beings. It also has an eye on the 2016 Olympic Games, which, like other major sports events, could create opportunities for increased criminal activity.”The agreement on strategic cooperation between Brazil and Europol will be of particular importance, particularly in the run-up to the 2016 Olympic Games, to support the fight against organised crime, including human trafficking and cybercrime”, said Civil Liberties Committee Chair and rapporteur on this file, Claude Moraes (S&D, UK).”This agreement will enable the exchange of specialist knowledge, information as well as advice and support related to criminal investigations, with full respect for fundamental rights to privacy and without involving the exchange of personal data”, he added.
Brazil is increasingly relevant in the fight against organised crime, such as facilitated illegal immigration and trafficking in human beings, drug-related crimes and credit card fraud, as well as other cybercrime-related activities, says Europol. It is also of particular interest in the area of counter-terrorism and asset recovery, it adds.The agreement, approved by 516 votes to 68 with 126 abstentions, provides for the exchange of information, which may include specialist knowledge, general situation reports, results of strategic analysis, information on criminal investigation procedures and crime-prevention methods, participation in training activities, and the provision of advice and support in individual criminal investigations. It does not provide for the exchange of personal data.
Now that Parliament has been consulted, the Council of Ministers can authorise Europol to formally conclude the agreement with Brazil, enabling it to enter into force. The UK, Ireland and Denmark are taking part in approving and applying the deal.
Under current rules, Parliament must be consulted before the Council establishes police cooperation agreements with third countries. However, in recently-concluded talks on new rules to govern Europol, Parliament’s negotiators insisted on inserting a review clause in all such agreements. This means that all existing international agreements between Europol and third countries must be assessed within five years of the new regulation’s entry into force, in order to check that they comply fully with data protection standards and meet EU standards on policing.Under the Lisbon Treaty, Parliament decides on an equal footing with Council on the rules governing Europol. Once the new Europol regulation enters into force, Parliament will be required to approve all new international police agreements.

Debate on migration and refugee crisis ahead of 15-16 October EU summit

european parliamentParliament will debate the ongoing refugee and migration crisis and the latest developments in Syria and Turkey on Wednesday at 15.00, ahead of the 15 and 16 October meeting of EU heads of state or government, in Brussels. In the debate, with Commission President Jean-Claude Juncker and Luxembourg’s minister for relations with the European Parliament during the Presidency of the Council of the EU, Nicolas Schmit, MEPs will also raise questions about completing the Economic and Monetary Union and the UK’s “in/out” referendum plans. European Parliament President Martin Schulz will address the European Council on Thursday, followed by a press conference. An extra €401.3 million in EU funding to tackle the refugee crisis will be put to a plenary vote at 19.00. The funds will go to the EU countries in which currently high numbers of migrants arrive, to non-EU countries hosting most Syrian refugees and to three EU agencies handling migrant and refugee-related tasks, Frontex, EASO and Europol. The draft amending budget 7/2015 foresees €100 million for the Asylum, Migration and Integration Fund (AMIF) and the Internal Security Fund (ISF) in commitment appropriations; €1.3 million in commitment and payment appropriations for 120 new posts at Frontex, EASO and Europol agencies; and €300 million in commitment appropriations for the European Neighbourhood Instrument.

Immigrazione: PE dovrebbe approvare stanziamenti extra per 69,6 milioni di euro

Le tre agenzie che si occupano dei flussi migratori verso l’UE e i fondi UE per le politiche migratorie dovrebbero ottenere un aumento di 69,6 milioni di euro nel bilancio di quest’anno, qualora, martedì, il Parlamento sostenesse la proposta della Commissione europea. Il Parlamento aveva chiesto maggiori impegni di bilancio, sulla scia delle tragedie dello scorso aprile che sono costate la vita a circa 1.200 immigrati.I deputati della commissione per i bilanci hanno rilevato che anche questo aumento potrebbe non essere sufficiente a soddisfare le esigenze reali del Mediterraneo, per non parlare di una possibile futura migrazione dall’Ucraina. L’aumento di bilancio di 75,7 milioni di euro in impegni e di 69,6 milioni di euro in pagamenti sarebbe finanziato con i fondi per il sistema di navigazione satellitare europeo Galileo, che gli eurodeputati desiderano ricostituire nel 2016. Le tre agenzie che dovrebbero ricevere questi fondi sono: FRONTEX, l’Ufficio europeo di sostegno per l’asilo e l’Ufficio europeo di polizia (Europol). I ministri dell’UE hanno approvato gli aumenti il 19 giugno.
