Immigrazione: continua la presa in giro dell’U.E.

triesteTrieste. “Grande preoccupazione per il nulla di fatto dopo i vertici di Tallinn e Varsavia in merito all’emergenza immigrazione nel nostro Paese e in relazione ad aiuti concreti che, anche in considerazione delle aspettative del ministro Minniti e del governo, dovevano arrivare e non sono arrivati all’Italia.Dopo l’inutile vertice di ieri – otto ore, tanto fiato al vento, zero risultati concreti –, quest’oggi il direttore dell’agenzia Frontex, Fabrice Leggeri, in audizione al Parlamento europeo conferma le sbiadite conclusioni lette negli organi di informazione: ‘Ho sentito la richiesta dell’Italia’ di predisporre lo sbarco dei migranti salvati in mare anche nei porti di altri Paesi oltre all’Italia, ‘ma non ho sentito disponibilità da parte di nessuno degli altri Stati membri partecipanti alle operazioni navali di Frontex’. ‘Ci sarà un gruppo di lavoro tecnico che si occuperà di elaborare proposte per cambiare il piano operativo dell’operazione Triton’. ‘Ci sarà un bilaterale tecnico Frontex-Italia per elaborare una serie di proposte che saranno poi condivise con tutti gli Stati che partecipano all’operazione’. Niet deciso, dunque, dai partner Ue e una serie di pensierini con tanti buoni propositi… ma il governo italiano si ritrova ancora una volta con un pugno di mosche in mano”.Lo scrive su Facebook Renato Brunetta, capogruppo di Forza Italia alla Camera dei deputati.“Dispiace dirlo, ma basta analizzare il lessico usato da questi burocrati Ue per capire che ci troviamo di fronte ad un’ennesima presa in giro. ‘Gruppo di lavoro tecnico’, ‘proposte’, ‘piano operativo’, ‘bilaterale tecnico’, il tutto condito dall’onnipresente ‘ci sarà’… Tutto, sempre rinviato.A questo punto ci aspettiamo un intervento chiarificatore da parte del ministro dell’Interno, Marco Minniti, che magari potrebbe prendere in considerazione l’ipotesi di riferire in Parlamento in merito alle ultime novità (???) emerse dopo i vertici di Tallinn e Varsavia.Ad ogni modo il Paese e i cittadini italiani vogliono conoscere la posizione del governo. Che farà l’esecutivo Gentiloni dopo le porte in faccia ricevute nelle ultime settimane in Europa? Come agirà? Come difenderà i nostri territori e il nostro tessuto sociale? Al momento registriamo solo un imbarazzato silenzio.Sullo sfondo l’emergenza continua, e l’Italia dovrà affrontare, ancora una volta, da sola i mesi estivi con migliaia e migliaia di disperati che arriveranno nei porti delle nostre regioni del Sud. E Renzi, il segretario del partito azionista di maggioranza del governo, che per pubblicizzare il suo libro, parla di numero chiuso e di altre corbellerie irrealizzabili di questo tipo. Siamo alla frutta”, conclude Brunetta.

European Border and Coast Guard multiannual programme

europa comunitariaFrontex’ multiannual programme for 2017-2019 will be presented to the Civil Liberties Committee on Thursday morning 11.30-12.30 by Fabrice Leggeri, Executive Director of Frontex. MEPs will also debate the implementation of the new European Border and Coast Guard regulation.The plans to upgrade the EU border control system, bringing together the EU’s Frontex border agency and national border management authorities, was endorsed by MEPs on 6 July 2016. The purpose of the new system is to ensure that the EU external borders are safer and better managed. Under the new mandate, national authorities will still manage their borders on a day-to-day basis but, if their EU external borders are under pressure, they will be able to seek help from the new European Border and Coast Guard Agency (EBCG). A rapid reserve pool of at least 1,500 border guards and a technical equipment pool will be put at the disposal of the Agency. The European Border and Coast Guard Agency was officially launched the beginning of October, less than a year after it was first proposed by the Commission.

Migrazioni senza controllo

“Secondo Frontex nel 2015 sono stati rilevati 1,83 milioni di attraversamenti irregolari di migranti alle frontiere esterne all’Unione europea, a fronte dei 283.500 dell’anno precedente. È un dato che va considerato e dal quale si deve leggere appunto l’incapacità dell’Europa e quindi anche del nostro Governo, in rapporto all’Europa, di porre in essere misure di politica estera utili a fronteggiare questa invasione”. Lo ha detto l’onorevole di Forza Italia, Roberto Occhiuto, intervenendo nell’Aula di Montecitorio alla discussione della mozione del M5S sulle linee della politica europea ed estera dell’Italia alla luce delle recenti emergenze internazionali. “Noi riteniamo – ha aggiunto Occhiuto – che alla luce di ciò sia urgente e improcrastinabile l’implementazione di una politica migratoria europea comune e coerente, che affronti il tema del controllo delle frontiere e della stabilità, affronti anche il tema dello sviluppo dei Paesi di origine e di transito e che contempli interventi mirati a contrastare gli scafisti in partenza dalla Libia e dalla Tunisia”.

Make it easier for migrants to complain about Frontex border guards, MEP say

african_migrants.jpg.crop_displayThe EU’s Frontex border agency should set up a mechanism to process individual complaints about alleged breaches of the fundamental rights of migrants and asylum seekers, say MEPs in a joint resolution voted by the Civil Liberties and Petitions committees on Monday. MEPs want the the European Commission to include provisions for this mechanism in a review of the Frontex regulation, due in December.The draft resolution, passed by 62 votes to 11 with 6 abstentions, backs the European Ombudsman’s 2012 recommendation that Frontex set up a complaints mechanism on alleged breaches of fundamental rights.
MEPs say the mechanism should become a first-instance body for complaints, and recommend that all persons acting under the Frontex emblem should wear a visible name or identification number on their uniforms.All persons who feel harmed by border guards wearing the Frontex emblem should have the right to submit a complaint, MEPs propose. They add that third parties should also be able to submit complaints on behalf of bona fide complainants, but to prevent misuse of the complaints mechanism, they recommend that anonymous complaints should not be accepted.
MEPs call for additional resources to be allocated to ensure that the Frontex Fundamental Rights Office is adequately equipped and staffed to handle complaints. They also stress the need for special protection of unaccompanied minors, women victims of gender-based persecution, LGBTI persons and other vulnerable groups.

Parliament to debate EU’s border and asylum agencies

european parliamentMEPs will discuss the roles, resources and capabilities of the EU border agency Frontex and the European Asylum Support Office with the Latvian Secretary of State for European affairs, Zanda Kalniņa–Lukaševica, and Migration Commissioner Dimitris Avramopoulos on Wednesday evening.Tackling the tragic situation in the Mediterranean, improving the management of migration flows prompted by a mix of motives, ensuring the surveillance of the EU’s external borders, rescuing migrants in distress at sea and supporting EU countries whose asylum and reception systems are under particular pressure are among the issues at stake.
MEPs from the Civil Liberties, Justice and Home Affairs Committee will visit the headquarters of the EU border agency Frontex, in Warsaw (Poland), on 16 and 17 February. Barbara Kudrycka (EPP, PL), Juan Fernando López Aguilar (S&D, ES) and Jeroen Lenaers (EPP, NL) will meet Frontex’s Executive Director, Fabrice Leggeri, and other staff to discuss the EU agency tasks, budget and organisation, possible changes to the Frontex regulation, the role of Frontex in Eurosur, plans for a European System of Border Guards, fundamental rights and recent developments, including the Triton operation in the Mediterranean.

Rules to prevent further loss of migrants’ lives off EU coasts

Draft rules to clarify how border guards serving in Frontex-coordinated maritime operations should deal with migrants intercepted or rescued at sea and where they should land them were approved by the Civil Liberties Committee on Monday. These rules should help to save lives, by removing confusion due to EU member states’ differing interpretations of international law. MEPs also inserted clauses to ensure that migrants’ rights are better protected.”The European Parliament has taken a step to respond to critics of Frontex operations by strengthening respect for the priority of saving lives. I hope that the Council will have the same priority and arrive swiftly at an agreement with Parliament to allow this regulation to take effect”, said rapporteur Carlos Coelho (EPP, PT).The draft EU regulation clarifies rules on the interception or rescue at sea of migrants and where they should be landed. These EU rules should remove confusion created by EU member states’ divergent interpretations of international law and practices. It should also improve the efficiency of Frontex-coordinated sea operations and help member states fulfil their duty to render assistance to persons in distress.The new rules should make it easier to ensure that border guards comply with all international obligations to render assistance to any ship or person in distress at sea.

Frontex: effective border management

During the negotiations, MEPs successfully introduced the notion of European Border Guard Teams, replacing and unifying the current Frontex Joint Support Teams and Rapid Border Intervention Teams (RABITS). The European Border Guard Teams will consist of a pool of national border guards assigned by Member States to the agency for joint operations, rapid interventions and pilot projects. Within one year, the European Commission will present a feasibility study on the establishment of a system of European Border Guards, one of Parliament’s initial proposals. To strengthen its effectiveness, Frontex will be able to purchase or lease its own equipment, such as cars or helicopters, either by itself or in co-ownership with a Member State. Under the compromise text, once the agency and a Member State agree on an annual plan, the country will be obliged to fulfil its commitments and contribute with staff and equipment to Frontex operations. The agreement also says that the agency will focus its activities on EU countries facing “specific and disproportionate” migratory pressures. Additionally, an Erasmus-style exchange programme for national border guards will be created.
Frontex will process personal data obtained during missions to use it in the fight against criminality, human trafficking and irregular migration. Data must not be stored for more than three months and will only be forwarded to Europol or other EU agencies on a case by case basis. Sending data to third countries will be prohibited.
One of Parliament’s key concerns in the negotiations was to ensure full respect for fundamental rights. At Parliament’s request, Frontex will appoint a fundamental rights officer and set up a consultative forum on fundamental rights. These will assist the agency’s management board and will have access to all information concerning respect for fundamental rights. The consultative forum will involve the EU Fundamental Rights and Asylum Support agencies, the UN High Commissioner for Refugees and NGOs specialised in this field.
To reinforce the democratic scrutiny of Frontex, the agency will be required to report regularly to the European Parliament on its fundamental rights activities. Parliament will also be regularly updated on Member States’ contributions to Frontex operations and on agreements with third countries and other agencies. The EP will also receive an annual report on the monitoring of return operations.
