The Supreme Court stamps on freedom of information

In 2011, the Argus Leader, a newspaper in Sioux Falls, South Dakota, was at work on a project about access to food and potential fraud in the food stamp program, which retailers administer in cooperation with the government. Jonathan Ellis, a reporter at the paper, requested data from the Department of Agriculture, which runs the program at the federal level, under the Freedom of Information Act, or FOIA. The department said no; the data Ellis requested, it argued, pertained to businesses, and was confidential. In response, the Argus Leader sued; it won, and the government decided not to appeal the verdict. But Ellis still did not get the data. The Food Marketing Institute, an industry group representing retailers, picked up the case and took it to an appeals court; when that court, too, upheld the Argus Leader’s request, the group—backed by the US Chamber of Commerce—escalated its secrecy fight all the way to the Supreme Court.The court, which heard arguments in the case in April, issued a ruling yesterday against the Argus Leader. The Freedom of Information Act has always allowed private government contractors to claim an exemption on confidentiality grounds, but—under a precedent set in 1974—contractors have had to show that disclosing the requested information would cause them competitive harm. Yesterday, in a 6-3 vote, the Supreme Court ruled to make that test substantially less strict: going forward, contractors will be able to keep any “commercial and financial information” they give to the government secret at their discretion, as long as the government gave them an “assurance” that it will remain private.” As Justice Stephen Breyer wrote in his dissent, the ruling establishes certain information as “confidential” not because it is legitimately sensitive, but because those who possess it want to keep it that way. The ruling, Breyer fears, “will deprive the public of information for reasons no better than convenience, skittishness, or bureaucratic inertia.”The Argus Leader—and press-freedom advocates—expressed similar concerns. Cory Myers, the paper’s editorial director, called the verdict “a massive blow to the public’s right to know how its tax dollars are being spent, and who is benefiting.” Ellis, who filed the initial FOIA (and co-wrote yesterday’s Argus Leader piece on the ruling), tweeted that while the Department of Agriculture’s denial of his request was never legitimate, “today, six members of the US Supreme Court used it as a vehicle to wipe out more than 40 years of established FOIA precedent.” Later, Ellis said he was “truly sorry to my colleagues who work to hold government accountable that my FOIA request was used to undermine our work. If I could go back in a time machine and change this I would.”
Clearly, none of this is Ellis’s fault. But experts fear that the court’s ruling will make journalists’ lives more difficult. “Businesses in regulated industries will be the main beneficiaries of this decision, while the press and public will have a harder time using the FOIA to investigate such businesses and their interactions with government agencies,” Jonathan Peters, a media law professor at the University of Georgia and CJR’s press freedom correspondent, tells me in an email. Michael Morisy, founder of MuckRock, a collaborative news site focused on FOIA and transparency, adds that the ruling will be particularly damaging in a climate of increasing privatization of government services. “Already, at the state level, we see contractors push the meaning of confidential trade data to include everything from how much they charge agencies (and therefore, the public) to the header columns of spreadsheets that summarize public data,” he tells me in an email.While this is a federal ruling on a federal law, local reporters will not be spared the impact. State governments have their own freedom of information laws which will not directly be affected by the Supreme Court’s decision. But reporters such as those at the Argus Leader commonly look at the local footprint of federal programs. And, as Avi Asher-Schapiro, of the Committee to Protect Journalists, reported ahead of the Argus Leader hearing in April, some states lack significant case law around access to information, and thus often use comparable federal laws as guidance.Ultimately, the Supreme Court’s decision only adds to the mounting impediments American journalists face at work. Trump’s anti-press attacks grab the headlines, but subtler trends like the weakening of transparency laws may have a deeper impact. “This decision is of a piece with government efforts nationwide to shield information and events from public view,” Peters says. “It’s offensive to the basic idea that our democratic system is based on the will of the people… The Argus Leader case does even more damage to that idea.” (font: CJR Editors)

Improved law enforcement access to financial information to curb crime

New rules improving law enforcement authorities’ access to financial information to investigate serious crime were adopted by MEPs on Wednesday
Financial data can offer valuable information to law enforcement authorities and can help them prevent, detect, investigate and prosecute serious crime and terrorism. The new rules, already agreed with EU ministers, aim to improve law enforcement authorities’ access to information and the cross-border exchange of financial information between EU authorities.
The new measures include the following changes:competent law enforcement authorities will be able access to bank account information for the prevention, detection, investigation or prosecution of criminal offences;
financial intelligence units (FIU) will be required to cooperate and reply in a timely manner to requests for financial information or analysis from the competent law enforcement authorities; national competent authorities will be required to reply in a timely manner to requests for law enforcement information by the national financial intelligence units;
national financial intelligence units will be entitled to exchange any information related to terrorism and organised crime associated with terrorism; and
better cooperation between authorities in different member states and improved exchange of information between Europol and national financial intelligence units.
The new rules were adopted by 574 to 26, 6 abstentions. The text still needs to be formally approved by the Council before entering into force. EU countries will have two years to put the rules into practice.

Improving data exchange between EU information systems

New measures to improve data exchange between EU information systems to manage borders, security and migration were adopted by MEPs.The new rules will make EU information systems used in security, border and migration management interoperable enabling data exchange between the systems. This will facilitate the tasks of border guards, migration officers, police officers and judicial authorities by providing them with more systematic and faster access to various EU security and border-control information systems.The main elements of the new legislation are:
European search portal allowing simultaneous searches, rather than searching each system individually;
Shared biometric matching service for cross-matching fingerprints and facial images from several systems;
Common identity repository providing biographical information such as dates of birth and passport numbers for more reliable identification;
Multiple identity detector, detecting whether a person is registered under multiple identities in different databases.
Furthermore, proper safeguards will be in place to protect fundamental rights and access to data.
The systems covered by the new rules would include the Schengen Information System, Eurodac, the Visa Information System (VIS) and three new systems: the European Criminal Records System for Third Country Nationals (ECRIS-TCN), the Entry/Exit System (EES) and the European Travel Information and Authorisation System (ETIAS).The rules on interoperability between EU information systems focusing on borders and visa were adopted by 511 to 123, 9 abstentions. The legislation on interoperability between EU information systems focusing on police and judicial cooperation, asylum and migration was approved 510 to 130, 9 abstentions.The new rules have already been agreed upon by the Parliament and Council negotiators in February. After the formal approval of the Council, member states will have two years to adopt the new rules.

Civil Liberties MEPs back rules improving data exchange between EU information systems

The new rules aim to improve data exchange between EU information systems used in security, border and migration management. They will facilitate the tasks of border guards, migration officers, police officers and judicial authorities by providing them with more systematic and faster access to various EU security and border-control information systems.Civil Liberties MEPs backed the deal regarding borders and visa information systems by 43 in favour, 11 against, no abstentions and the agreement on police and judicial cooperation, asylum and migration information systems by 44 in favour, 10 against, no abstentions.
The agreed texts now needs to be formally approved by the Parliament as a whole and the Council of the EU before entering into force.

Patients Search for Information Online

Recent research commissioned1 by Teva Pharmaceuticals has shown that patients, especially those with chronic conditions, have a significant need for online information but they question the reliability of some sources.
Today, Teva in Europe announced a series of partnerships and initiatives aimed at directly addressing this unmet need. “Workshop internazionale sul consenso information e ricerca clinica”

Roma Dal 21 al 23 febbraio 2018,Via degli Aldobrandeschi 190, Ateneo pontificio Regina Apostolorum la Cattedra UNESCO in Bioetica e Diritti Umani terrà il suo sesto workshop internazionale per discutere le questioni del consenso informato e della ricerca clinica. Facendo parte del consorzio i-Consent (progetto finanziato dall’Unione Europea – Horizon 2020), la riflessione etica del workshop si concentrerà sulla dimensione multiculturale e interdisciplinare dei requisiti etici del consenso informato applicato alla ricerca trasnazionale/clinica e vaccinazione. La discussione si svolgerà nell’Aula Master dell’Ateneo Pontificio Regina Apostolorum e dell’Università Europea di Roma, in Via degli Aldobrandeschi, 190 a Roma (ingresso riservato). Molti gli interventi autorevoli (in allegato il programma dettagliato).
“Teniamo molto a questa importante giornata di studio e di dialogo su un tema così importante – dichiara Alberto Garcia, direttore della Cattedra – perché nella ricerca scientifica troviamo brecce, barriere e pratiche nel processo di richiesta del consenso informato. Troppo spesso non si prendono in considerazione pienamente la persona umana e i suoi diritti fondamentali, e la diversità culturale e religiosa dei soggetti di sperimentazione biomedica. Per questo motivo il nostro workshop è importante: abbiamo bisogno di partire dai valori comuni che i vari credi interpellati condividono, per analizzare insieme le differenze e adattare (anche) le politiche sanitarie a realtà più complesse e meno monolitiche”.
“È importante discutere e confrontarci sul limite tra autonomia e relazione nel consenso informato; – continua P. Joseph Tham, L.C. professore di Bioetica – insieme alla Prof.ssa Marie Letendre abbiamo analizzato come nel tempo la percezione dell’autonomia del paziente nel consenso informato stia cambiando. Si sta passando da un concetto di processo decisionale autonomo a un rapporto più articolato e relazionale tra paziente-dottore. Per tanto abbiamo voluto dimostrare lo spostamento da una forma individualista a una più relazionale che aiuti a comprendere l’autonomia nel dare il consenso, senza tralasciare gli aspetti culturali ed etici nel sistema sanitario”.

Weighing the pros and cons of sharing information among EU borders and security systems

Interoperability between information systems for borders and security can help border and law enforcement officials thanks to fast and easy access to information about non-EU nationals entering the EU. However, as a new paper from the European Union Agency for Fundamental Rights (FRA) shows in addition to benefits, there are also fundamental rights risks. These include using data for some purpose other than the one were designed for, unlawful access to personal data, replicating incorrect data about a given person, and children being linked to immigration offences their parents committed.
The Fundamental rights and the interoperability of EU information systems: borders and security paper shows that interoperability does not intrinsically violate fundamental rights and can help support better decision making through providing fuller information. This can improve efficiency, lead to mistakes in the systems being corrected, help identify those in need of international protection already flagged in one system as well as support the detection of missing or trafficked children.
However, the paper also underlines the need for adequate safeguards and mechanisms to protect the rights set out in the EU Charter of Fundamental Rights. This includes ensuring that the information stored is accurate and access is limited only for authorised purposes by authorised staff. Given the personal nature of the data, strong data security is needed to prevent unauthorised access, hacking, and the unlawful sharing of information with third parties.The systems should guard against sharing of inaccurate information and allow for corrections to be made. It should also ensure sensitive data such as race, ethnicity, health, sexual orientation, and religious beliefs does not lead to discriminatory profiling.Special attention should also be paid to children. As children develop their biometric information, such as fingerprints or facial images, may change. This reduces the reliability of the information stored. Also they may have criminal records due to immigration offences carried out by their parents. This should either be decoupled or limited to offences they committed.This paper reveals the positive and negative implications of making borders and security information systems interoperable. It was originally prepared to support the European Commission’s high-level expert group on information systems and interoperability. The group explored the legal, technical and operational aspects surrounding interoperability of information systems.

Fighting terrorism: share criminal records of non-EU nationals, too, urge MEPs

europolThe European Criminal Records Information System (ECRIS), which EU countries use to exchange information on the criminal convictions of EU citizens, should be extended to include non-EU nationals, Civil Liberties Committee MEPs said on Monday. MEPs also want the system to be used to check the criminal records of people seeking to work with children.The committee backed an EU Commission proposal to expand the ECRIS system to include information, of non-EU citizens by 45 votes to 2, with 4 abstentions. The new directive is a key measure under the European Agenda on Security and an important tool for fighting cross-border crime and terrorism.
“We need to restore public confidence that we are able to monitor who comes into the EU, and to find people who could represent a threat. Checking people against our existing criminal records databases, and making exchanging that information much easier, will go a long way towards showing that we can find those people who mean us harm, amongst the vast majority who do not”, said Parliament’s lead MEP on the file Timothy Kirkhope (ECR, UK), following the vote.MEPs also stress that member states should be able to use the ECRIS system to pass on information relating to terrorist offences or serious crime received bilaterally from a third country. Furthermore, they want the EU’s police cooperation agency Europol and border agency Frontex to be able to access the database, upon request and case by case, to perform their tasks.
Employers should also be able to request information about a person’s criminal convictions or any disqualifications arising from those convictions when recruiting him or her to a role involving “direct and regular contacts with children”, MEPs say. They add that member states should endeavour to provide similar safeguards with regard to persons who intend to work with disabled or elderly persons.
After the vote on the draft report, the committee gave the rapporteur a mandate to start three-way talks with member states and Commission.

Coordinated maritime surveillance for safer and more secure seas

ciseThe European Commission took a further step towards a more effective and cost-efficient surveillance of European Seas by announcing the Common Information Sharing Environment (CISE). By bringing together surveillance data from civil and military authorities like coast guards, navies, and fisheries and border control, duplication of work can be avoided and a potential €400 million worth of savings can be made every year.Increased cooperation and sharing of data will help to deal with “real time” events at sea such as accidents, spills, crime or any other security threat. CISE aims to help the relevant actors share live information and data and is a key part of the recently adopted European Maritime Security Strategy.The CISE Communication is indicative of the progress and commitment made at EU and national level since a roadmap was outlined in 2010. It proposes guidance and priorities for further action with a main focus on how to further enhance information exchange – in particular between civil and military authorities – to better interconnect existing maritime surveillance systems. This will bring allow for more effective and timely co-ordination of maritime surveillance operations in EU waters. It will help create a safer investment climate for blue growth and ensure the security of EU citizens.The Commission will launch a project under the EU’s 7th Framework Programme for Research in order to test Maritime CISE on a large scale. Along with Member States, it will produce a best practice handbook on how to apply CISE based on experience from existing systems and pilot projects like MARSUNO, Bluemassmed and Cooperation.Maria Damanaki, Commissioner for Maritime Affairs and Fisheries, said: “Sustainable economic growth within the maritime sector can only be ensured if our seas and oceans are safe and secure. CISE aims to make sure that all involved maritime surveillance actors have a complete picture of all events at sea. Sharing such information is key to avoid duplication in collection of data and for the use of patrol ships, planes, helicopters or satellites in the same sea areas. Today, about 40% of information is collected several times and 40% to 80% of information is not shared amongst the interested users. We cannot afford such a waste of efforts and money”.(cise)
