European values: COVID-19 emergency measures pose a “risk of abuse of power”

On Tuesday, the Civil Liberties Committee approved a draft resolution that takes stock of the state of European values in the context of national measures taken to tackle the COVID-19 pandemic, with 50 votes to 11 and 3 abstentions.MEPs concluded that national emergency measures pose a “risk of abuse of power” and stressed that any measure affecting democracy, the rule of law, and fundamental rights must be necessary, proportional and time-limited. They call on governments to consider terminating their “state of emergency” or at least to clearly define the delegation of powers to their executives, and to ensure that appropriate parliamentary and judicial checks and balances are in place.MEPs urge the Commission to conduct an evaluation of “first wave” measures, in addition to the initial comments included in its first annual rule of law report, and emphasise the need for a permanent, effective monitoring mechanism.EU countries have to “exercise utmost restraint” when restricting the freedom of movement (especially in relation to the right to family life), while the Commission should scrutinise the application of Schengen rules.MEPs warn against undue restrictions to the freedom of assembly and changes in legislation while citizens are unable to protest. In this context, the need to guarantee free and fair elections becomes even more important, especially with regards to implementing changes to electoral legislation, ensuring equal rights in campaigning, and alternative forms of voting. Disinformation threatens citizens’ health and their trust in public institutions, and has also been used as a pretext to restrict freedom of expression. The best way to tackle this, MEPs say, is by supporting independent journalism and media pluralism (including through transparent allocation of funds to media) as well as by improving journalists’ working conditions.Member states should guarantee the right to education by ensuring that classes continue and students have access to them. Furthermore, they should find solutions through technology or judicial cooperation to safeguard the rights of defendants, and to protect the rights of all persons in their prisons.MEPs finally warn that disinformation stigmatises migrants and has increased discrimination, racism, xenophobia, and hate speech against persons with disabilities, asylum seekers and refugees, people of Romani heritage and LGBTI+ persons. Parliament is scheduled to vote on this resolution during the 11-13 November plenary session.

Marco “Puglia” Puglisi came out of the north-western musical tribe of Italy about ten years ago, at the time he was a fresh-faced teenager in love with drugs and lo-fi sounding guitars. Released a bunch of bizarre records under the moniker of “A Morning Loss” and worked his way up through pubs and squats. Recorded an emocore cassette in 2017 with the band “Lettere Da Un’Occupante” and moved to London, England. After an epiphany with power-pop, his musical foundation veered towards more accomplished songwriting that led to the cherish but austere sound of his most recent works. In December 2019 La Fenice Recordings produced last Puglia’s work.“Blind Faith And A Little Wine”, stands as a brief collection of intimistic and acoustic pop tunes whose nine tracks clearly showcase the author’s fixations: melody and traditional pop structure. Quoting Big Star on “Hide”, Xtc’s pastoral songwriting on the title track, Jellyfish baroque ditties on “Fancy”, Byrds-in attitude on “A Questionable Reward Of A Visit To Inaccessible Island” and mimicking chamber pop on “Marseille”, Puglia makes a diligent work of transcription of the sacred writings of Britain’s and America’s classic pop. As a sign of the times, the record was made and conceived in the Italian province, a place where kids with laptops struggle to come out of a reluctant environment, but sounds as if a “brill bruising” disciple composed it. In other words, Puglia is one of the sons reinterpreting the music of their fathers, adding a touch of internet culture’s fear and a drop of melancholia for an “old world order”.

The president of the Commercial Court of Casablanca ruled today in favor of Omar Belmamoun, CEO of Platinum Power. The company will not be put in bankruptcy. As such, the judge dismissed the US shareholder Michael Toporek. The request has therefore been closed.

Fuji Electric Awarded Geothermal Power Station Contract in Kenya

Fuji Electric Co., Ltd. (TSE:6504) (“FE”), headquartered in Tokyo, Japan, led by President Michihiro Kitazawa, is pleased to announce that it has been awarded a contract for a complete geothermal power facility for the Olkaria I Geothermal Power Station (Olkaria I) in the Republic of Kenya from Marubeni Corporation, the main EPC contractor of the project owned by Kenya Electricity Generating Company (KenGen). Marubeni Corporation is headquartered in Chuo-ku, Tokyo and led by President and CEO Fumiya Kokubu.Olkaria I is located about 120 kilometers northwest of Kenya’s capital city of Nairobi. It began operations in 1981 and was the nation’s first geothermal power station. It currently runs five turbines with a combined output of approx. 185 MW, making it one of the largest geothermal power stations in Africa.This undertaking will be Fuji Electric’s first geothermal power plant project in Africa. The contract calls for construction of a new 6th power generation unit (Unit 6). Construction funds for the project will be provided in the form of an Official Development Assistance (ODA) loan from the Japan International Cooperation Agency (JICA) and financing through the European Development Bank.

Third-generation member of the McQueen family, Molly, starred in a special movie of her own introducing the new third-generation Bullitt at the North American International Auto Show. In the film, Molly races a new Mustang Bullitt through a parking structure battling a Dodge Charger for the final free space.Helping it win that particular spot was the Bullitt’s upgraded 5.0-liter V8 engine that will deliver at least 475 horsepower and 420 lb.-ft. of torque, pushing the new Bullitt to a top speed of 163 mph – an 8 mph increase versus the latest Mustang GT. As a special-edition model due out this summer – the all-new Mustang Bullitt is equipped with a manual transmission, and the gear shifter features a white cue ball shift knob as a nod to the original. The vehicle packages all Mustang GT Premium and Performance Package content into a vehicle that maintains the original Bullitt’s understated persona.An active valve performance exhaust system is standard with new Black NitroPlate™ exhaust tips, and retuned to give the car a signature burble, as well as new Open Air Induction System and Shelby GT350 intake manifold with 87mm throttle bodies and powertrain control module calibration for optimal performance.Other standard equipment includes a heated leather steering wheel and a 12-inch all-digital LCD instrument cluster, identical in function to the cluster introduced on 2018 Mustang, but with a unique Bullitt welcome screen that starts in green with an image of the car rather than the pony. “This new Bullitt is, as Steve McQueen was, effortlessly cool,” said Darrell Behmer, Mustang chief designer. “As a designer, it’s my favorite Mustang – devoid of stripes, spoilers and badges. It doesn’t need to scream about anything – it’s just cool.”Exterior paint choices are limited to Shadow Black and the classic Dark Highland Green – as worn in the movie. Maria Lassnig: Woman Power a cura di Wolfang Drechsler

Maria Lassnig (1919 – 2014) è tra le artiste più significative della seconda metà del XX secolo, insieme a Luoise Bourgeois e Joan Mitchell. La sua pittura è singolare sia per quanto concerne lo stile che per il contenuto, il cui tema prediletto è l’artista stessa. La grande maggioranza dei suoi lavori sono infatti autoritratti, anche nei casi in cui le opere presentano un titolo diverso. In essi la fisionomia gioca solo un ruolo parziale: il mondo esterno, visibile, serve spesso solo come involucro di un percepibile mondo interiore.
Maria Lassnig ha svolto un ruolo fondamentale come precorritrice dell’universo femminista nell’ambito delle arti figurative, ruolo che è stato ben riconosciuto nel corso degli ultimi anni: l’artista è stata infatti premiata con il Leone d’oro alla carriera alla Biennale di Venezia del 2013. In mostra saranno esposte opere che coprono cinque diversi decenni di attività della Lassnig, tra le quali alcuni capolavori, al fine di ripercorrere l’evoluzione e i cambiamenti stilistici occorsi nella sua attività. La mostra è realizzata con la collaborazione dell’Albertina di Vienna.

The death of a former president tilts the balance of power in Iran

akbar-hashemi-rafsanjaniTEARS always came easily to the lachrymose ayatollah. But those at a gathering on December 13th seemed more heartfelt than most. He was reading from his own biography of Amir Kabir, the Shah’s chief minister in the mid-19th century, when the blubbing began. Kabir had tried to open the Persian Empire up to the West, he wept, only to be frustrated by the hand of a hardline assassin. “Something suggested he was thinking of his own failed attempts at reform,” says one of those present.With death approaching, Akbar Hashemi Rafsanjani, who died on January 8th aged 82, may also have had an eye on posterity. Eulogists are already hailing a lifetime spent trying to open Iran and its Islamic revolution to the West. Israeli officials were among the first to label him a moderate. In the midst of the Iran-Iraq war, they sold him arms. In return, he obligingly diverted the proceeds with a nod from America’s Republican leaders to the Contras, Nicaragua’s anti-communist rebels. “If people believe we can live behind a closed door, they are mistaken. We are in need of friends and allies around the world,” he explained. He persuaded Ayatollah Khomeini to end the war with Iraq, and no sooner was he anointed president than he began knocking on the door of Abdullah, Crown Prince of the Islamic Republic’s nemesis, Saudi Arabia, with which he quickly restored relations. American oil majors received invitations to return to Iran, and but for President Bill Clinton’s veto, might have come.Yet Mr Rafsanjani was also a stalwart of the regime, who believed the best way to preserve it was to accommodate outside pressures, not to defy them. Once Ayatollah Khomeini was secure as Supreme Leader, Mr Rafsanjani began eliminating the allies—Marxists, religious nationalists and rival Islamists—who had joined him in toppling the Shah. Abroad, he orchestrated assassinations and the bombing of a Jewish community centre in Buenos Aires, said prosecutors in Germany and Argentina. To compensate for the deficiencies of Iran’s air force and navy, he is said to have initiated the country’s nuclear programme. That was for peaceful purposes, he always insisted. But Persian is a famously elastic language, and he was a master of ambiguity. He was dubbed kooseh, the shark, on account of his smooth rubbery skin, which made it hard for him to emulate the pious beards of Iran’s more senior ayatollahs. But he also had a shark’s knack of gobbling up those who stood in his way.He made an unlikely revolutionary. Whereas his peers emerged from the ranks of Iran’s downtrodden, his father was a gentrified pistachio farmer. Mr Rafsanjani briefly studied in Qom, Iran’s holy city, under Ayatollah Khomeini, until the latter fled the Shah’s goons in 1964, but was known for his truancy. If he had a constituency it was less Qom’s seminaries than the gold arcades of Tehran’s bazaar. When Ayatollah Khomenei addressed his followers, he did so from the humble surroundings of his mosque, Hosseiniyeh Jamaran, tucked into the cramped alleyways on Tehran’s heights. When Mr Rafsanjani held court, he sat on a dais in the throne room of one of the Shah’s old downtown emerald palaces.
Iran’s self-interest had a way of becoming his own. He championed opening university education to all. But some noted that the many branches of the Islamic Azad University over which he presided could also be used to build up real estate. Its assets, many acquired from the government as public works, are estimated to be worth tens of billions of dollars. He championed privatisation, but like most Middle Eastern leaders used it to bolster his cronies and closer relatives. He sent his son on missions to Saudi Arabia. As the epitome of the fatted elite, the electorate turned on him when he tried to return as president in 2005. Ironically, Mahmoud Ahmadinejad was judged the force for change, and attracted the youth vote.Yet no other Iranian so continuously dominated the revolution. For the Islamic Republic’s first decade (1980-89), he was parliamentary speaker; for the second (1989-97), its president. In Ayatollah Khomeini’s last months, he engineered the removal of the designated next Supreme Leader, and his replacement by a little-known lesser cleric, whom he hoped would be more malleable: Ali Khamenei. Mr Ahmadinejad aside, the presidents that came after him were his protégés. Muhammad Khatami reappointed many of Mr Rafsanjani’s senior ministers to his cabinet in 1997. And at the reformist President Hassan Rouhani’s inauguration in 2013, Mr Rafsanjani was seen beaming even more broadly than the incumbent himself. Mr Rouhani, after all, was his old national security adviser.Mr Rafsanjani’s defeat by Mr Ahmadinejad helped him redeem himself in the eyes of the electorate. A gruelling month after the streets erupted in protests in 2009, he took to the pulpit to denounce Mr Ahmadinejad for rigging elections to secure a second term. “Go,” he cried at Friday prayers, echoing Ayatollah Khomeini’s riposte to the Shah. His daughter, Faezeh, was arrested for joining the protests, as was his son, Mehdi, in 2015. In the 2016 elections Tehran’s middle classes rewarded him by voting him top of their list. A satisfied Mr Rafsanjani pronounced his political mission accomplished. As his star waned, he increasingly sparred with Mr Khamenei, questioning not just the belligerence of Iran’s foreign policy, but the very notion of rule by a single cleric.Some hardliners are already cheering that their most powerful opponent has gone; as chairman of the Expediency Council (a job he held from 1989 until his death) Mr Rafsanjani helped hold the balance between moderates in parliament and the conservative Guardian Council that is meant to ensure that all laws are in conformity with Islam. With his godfather departed and the presidency of Donald Trump imminent, some see Mr Rouhani’s hopes not just of re-election in May but rapprochement with the West as gravely weakened. Others argue, however, that set free from Mr Rafsanjani’s shadow, Mr Rouhani could emerge stronger if he wins his second term in May. Either way, the regime has lost an arch-pragmatist. Expert comment: Betfair and Paddy Power £5bn merger a simple case of consolidation

Betfair and Paddy Power are set to merge in a £5bn deal that would create one of the world’s biggest online betting and gaming companies, Nigel Driffield, Professor of Strategy & International Business at Warwick Business Schoolhas made the following statement:“This is a simple case of consolidation. There are simply too many betting shops that do not pay their way, and online there are huge economies of scale. Online betting encourages people who make small bets ‘for fun’ but still have to be processed.“Betfair’s niche is that they make smaller margins than the high street bookies, and are one of the strongest online providers with the exchange service, as well as pioneering initiatives others have copied like cash out. “Paddy Power typically have their roots in horse racing and seem to be struggling to establish a presence in other sports – the growth in sports betting in the last 10 years has been in football.”

Panama Suspends Construction of FMO-funded Barro Blanco hydroelectric dam over environmental and human rights abuses

The decision was publicly announced by Panama’s Environmental Agency, ANAM, Monday. The indigenous communities whose land would be flooded by the dam had demanded the suspension for years. Although the decision comes when the dam’s construction is near to completion, the Movimiento 10 de abril (M-10) is satisfied that steps are finally being taken to address their concerns.“We have been intimidated and some of our members were even sued in court, but we have always persisted in claiming our right to be consulted on projects in our territory,” said Manolo Miranda, representing the M-10. Since the new government took to power in 2014, there has been increased recognition of the communities’ grievances, finally leading to this ground-breaking decision.The Barro Blanco dam, once completed, is expected to flood homes, schools, religious, archaeological, and cultural sites in the Ngöbe-Buglé comarca (indigenous traditional territory). The project will require part of the indigenous Ngöbe communities currently living on the shores of the river to leave their land to which they have strong cultural ties.ANAM finally decided to suspend construction after finding the project to be out of compliance with its environmental impact assessment (EIA). The breaches include, among other things: the lack of agreement with the affected communities, absence of an approved archaeological management plan, repeated failures to manage sedimentation and erosion, poor management of solid and hazardous waste, and logging without permission.Two Dutch and German development banks, FMO and DEG respectively, have each invested USD 25 million in this project. They invested in this controversial dam despite the fact that local communities and civil society had raised concerns about the project with them. After critical reports by the UN Development Programme and the UN Special Rapporteur on the Rights of Indigenous Peoples, the current suspension is yet another very strong signal that FMO and DEG largely underestimated the adverse human rights and environmental impacts of the project.“FMO and DEG never came to the affected area to see whether the project complied with their policies and national laws,” explained Manolo Miranda. This news comes at the same time FMO and DEG’s Independent Complaints Mechanism (ICM) is investigating a complaint filed by local groups including the M-10, with support from Both ENDS and SOMO. The ICM’s compliance report is expected to be published in mid-March.“FMO and DEG should respond publicly to the report. If the ICM finds that FMO and DEG failed to comply with their own policies, they must identify how to bring the project back into compliance with its policies or divest from the project completely.” said Anouk Franck, a senior policy advisor at Both ENDS.
“The FMO asserts that when it finances projects, it has leverage to improve their clients’ environmental and social performance,” said Kris Genovese, a senior researcher at SOMO. “FMO has failed to do so in the course of this project and more so, failed to assess the extent to which the affected community was left out of decision-making.” “We repeat our request to FMO to use its leverage to ensure that the human rights of the Ngöbe are finally respected. Free prior and informed consent is the bottom line. The failure to ensure FPIC in this project has led to unnecessary conflict. I hope FMO will learn that in future projects it needs to deal with human rights from the start,” said Anouk Franck.

Fred Danska di Wartsila presenterà le ultime opinioni riguardo a questa potenzialmente importante alternativa.Perché tali progetti quali lo ‘shoreside’ abbiano successo, tutte le partnership sono estremamente importanti. Il Porto di Venezia condurrà un dibattito su come queste funzionino per il capoluogo veneto. La conferenza vedrà la partecipazione di una vasta gamma di stakeholder, inclusi i porti, le compagnie di crociera, i fornitori di attrezzature e l’Unione Europea.

Urgence pour une politique d’hospitalité. Depuis près de 40 ans, le dogme de la fermeture des frontières structure les politiques publiques en matière d’immigration. L’Europe s’est cadenassée face aux migrants, tout en délégitimant toute alternative fondée sur la solidarité et les droits, jugée coupable d’irréalisme et de naïveté. Pour nous, l’état des lieux est sans appel : incapable de répondre aux objectifs qu’elle s’est donnée, cette politique inefficace provoque de surcroit des dégâts humains considérables et met en péril nos libertés. En plaçant les migrants et leurs familles dans un dédale administratif et des conditions de plus en plus inatteignables pour l’obtention d’un titre de séjour stable, ce sont des dizaines de milliers de sans droits que la législation a créés, pour le plus grand profit de secteurs entiers de l’économie française qui peuvent ainsi utiliser une main d’œuvre docile et bon marché. Peu à peu, en matière de santé, de protection sociale, de logement ou de formation, l’exclusion est devenue la règle, le droit l’exception. Et pour ceux qui espéraient encore des conditions de vie différentes de celles qu’ils avaient fuies de leur pays d’origine, les objectifs chiffrés d’expulsion ont signifié un message clair : vivez cachés ou l’expulsion vous attend. Les étrangers auront ainsi, depuis près de 40 ans, subi le sort souhaité à tous par les tenants du dogme libéral : déconstruire les droits pour en revenir au « tous contre tous », baser les rapports humains sur la valeur marchande et la prédation, en finir avec les principes de solidarité, d’égalité, de justice. Construire une société de « sans droits ». Dans le même temps, le poison des vieux démons xénophobes et racistes n’en finit pas de prospérer sur le terreau de la désespérance sociale. La haine de l’étranger ou de l’autre continue plus que jamais à scander le rythme des discours politiques, détournant le regard des citoyens des enjeux autrement plus graves de sous-emploi, d’inégalités sociales et d’injustice fiscale. Dans ce contexte, l’intégration des immigrés est devenue une injonction généralisée, visant à discriminer les étrangers en s’appuyant sur l’argument de « l’assimilation » à de supposées « valeurs communes », qui ne sont que le masque d’un nationalisme d’exclusion.Nous affirmons que notre conception du « vivre ensemble » n’est pas construite sur ces valeurs et qu’elle en est même aux antipodes. À la désespérance et la haine, nous opposons l’urgence d’un nouveau pacte citoyen qui nous rassemble en termes de droits comme d’obligations, quel que soit l’endroit où nous sommes nés. C’est à la réalisation d’une politique d’hospitalité que nous appelons, en France comme en Europe. S’appuyant sur l’égalité des droits, la solidarité et l’ouverture au monde, cette politique doit promouvoir une véritable citoyenneté de résidence, afin d’en finir avec les discriminations légales et d’inventer un droit à la mobilité qui place, au même rang, l’intérêt des migrants et l’impératif des États de garantir la paix et la sécurité. Réalisable, s’appuyant sur des propositions concrètes, cette politique d’hospitalité posera en acte une vision ouverte de l’avenir, considérant les migrants, à l’égal de nous-mêmes, comme des êtres au parcours intelligible, acteurs du monde et parties prenantes de la solution aux défis de notre temps.

President Sarkozy: “Insofar as I’m speaking just after the G20 summit, I would like to say to Barack Obama just how delighted I’ve been to be able to work hand in hand with him. I want to tell him how much I appreciate his open-mindedness and his clear determination to build a new world. And I can say that at this summit there have been no winners, there have been no losers. There were 20 leaders — of course, the leader of the world’s number one power, the USA, who shouldered the responsibilities, squared up to the responsibilities, and that all goes well for the months and years to come. We have a hell of a lot of work ahead of us because there’s a hell of a lot of problems we need to deal with. So this has been a very productive conversation. I look forward to further productive conversations this evening and tomorrow, surrounding NATO’s mission. And I’m confident that when the United States and France are acting in concert, that the prospects for peace and prosperity around the world are strengthened. And a word to the French. It’s extraordinary, you know, for years now we’ve been sending soldiers to fight under the NATO flag — and yet we have not had anyone participating in those committees that actually laid down the strategy. Now, I want it to be — I’ve shouldered the responsibility of my choices. NATO has been around for 60 years. And if there is peace and peace has prevailed, it is no coincidence — it is because we have worked together with our allies, and the first and foremost being the United States, who know perfectly well that France and other allies — this Europe of defense, it will comprise allies and friends, longstanding strong allies and friends”. (abstract) President Obama: “NATO is the most successful alliance in modern history. And the basic premise of NATO was that Europe’s security was the United States’ security, and vice versa. And with France’s reintegration into the highest command structures of NATO, that principle will continue to be upheld. I want to echo what President Sarkozy just said. We want strong allies. We would like to see Europe have much more robust defense capabilities. That’s not something we discourage. We’re not looking to be the patron of Europe. We’re looking to be partners with Europe.
