Kövesi to become EU Chief Prosecutor

• Laura Codruţa Kövesi was Parliament’s top candidate to become the first EU Chief Prosecutor
• The new office will investigate crimes against the EU budget such as fraud, corruption or cross-border VAT fraud
Parliament and Council negotiators agreed on appointing Laura Codruţa Kövesi, MEPs’ preferred choice to be the first head of the new EU Public Prosecutor’s Office.
The negotiations between the European Parliament and the Council on the new European Chief Prosecutor to lead the European Public Prosecutor’s Office (EPPO) have been ongoing since last spring. Parliament’s negotiating team has backed Ms Kövesi throughout the negotiations, despite opposition from Council until now.
After the agreement with the Council negotiators on Tuesday evening, Civil Liberties Committee Chair Juan Fernando López Aguilar (S&D, ES) said: “Ms Kövesi is the perfect choice to become EU Chief Prosecutor. She has excellent professional competences. Moreover, Romania does not currently hold any key posts in the EU. She will be one of the strong women leading in the EU from now on.” “We are very pleased that Ms Laura Kövesi will be leading the new European Public Prosecutor’s Office. She corresponds best to the European Parliament’s vision of a strong and credible EPPO. Ms Kövesi is extremely competent, with an impressive record of achievements in fighting corruption with remarkable resilience and great courage,” added Budget Control Committee Chair Monika Hohlmeier (EPP, DE)Civil Liberties Committee Vice-Chair Maite Pagazaurtundúa (S&D, ES) said: “With the selection of Ms Kövesi as European Chief Prosecutor, citizens will feel more safe and protected now that the European Public Prosecutor’s office can start its work. The new office will have a key role in cracking down on offences affecting the EU’s financial interests – only criminals will be restless after this agreement.”

Parliament reiterates its support to Laura Codruţa Kövesi to become EU Chief Prosecutor

The Parliament reaffirmed that Laura Codruţa Kövesi remains its top candidate to become the first head of the new EU Public Prosecutor’s Office.
Following to President Tajani’s announcement yesterday in plenary supporting Ms Kövesi’s candidacy and after three rounds of negotiations with the Council, the Parliament’s negotiating team reiterated its continued support to Ms Kövesi, a former Romanian anti-corruption watchdog whose candidacy is opposed by the Romanian government. The team also called on the Council to reconsider its position. European Public Prosecutor’s Office (EPPO) Chief Prosecutor has to be selected by joint accord between the Parliament and the EU Council.“After the third negotiation meeting with the Council delegation, we deeply regret the current deadlock situation, which prevents the two institutions from appointing the European Chief Prosecutor”, said Claude Moraes (S&D, UK), Chair of the Civil Liberties Committee. “The European Chief Prosecutor will play a key role in the implementation of the EPPO, an office that will be instrumental in combatting crimes against EU budget”, he concluded.Civil Liberties Committee Vice Chair Judith Sargentini (Greens/EFA, NL) said: “The obstruction Ms Kövesi is currently facing from the Romanian authorities highlights her courage and her independence, which both are crucial requirements for the efficient functioning of the EPPO. The harassment of the Romanian government has resulted in completely discrediting the Council’s candidate as well.” “Unlike the Council, the Parliament has held hearings of all three shortlisted candidates. Ms Kövesi is by far the strongest and most promising candidate for the post. We cannot accept the fact that the Council cedes to the pressure of the Romanian government to support a much weaker candidate. Since the EPPO regulation has been watered down during negotiations, it is crucial for the Parliament to select a candidate who would make the institution strong and credible,” Ingeborg Gräßle (EPP, DE), head of the Parliament’s Budgetary Control Committee, told after the third round of negotiations on Thursday. “She is a woman, and the Parliament has just recently called on the Council to respect the principle of gender balance. Moreover, Romania currently does not hold a single EU key post,” she added.Following a pre-selection by a board of experts, EU legislators now have to pick from Ms Kövesi and Jean-François Bohnert from France. The parliament’s negotiating team consists of Mr Moraes, Ms Gräßle and Ms Sargentini.

EU public prosecutor: MEPs call for clearer scope, defence rights

european parliamentThe powers of the future European Public Prosecutor’s Office (EPPO) should be clearer and the EPPO should make sure that defence rights are properly protected in all its activities, said the European Parliament in a resolution passed on Wednesday.The non-legislative text, passed by 487 votes to 161 with 30 abstentions, sets Parliament’s priorities and red lines for giving its consent to the EPPO proposal when the moment comes.”I hope that as many member states as possible participate in the European Public Prosecutor’s Office to defend the EU’s financial interests”, said rapporteur Salvatore Iacolino (EPP, IT) before the plenary vote.The protection of the EU budget against fraud can be better achieved at EU level, MEPs underline. However, they urge member states to clarify the EU prosecutor’s powers and the relationship between the EPPO and other EU bodies, such as Eurojust and OLAF.The House also points out that the EPPO’s competences should only be extended to offences other than those affecting the EU’s financial interests under three conditions:when the conduct simultaneously constitutes a crime affecting the EU’s financial interests and other offences;
when the offences affecting the EU’s financial interests are predominant; and when the other crimes would be barred from further punishment if they were not prosecuted and brought to judgement together with the offences affecting the EU’s financial interests.

BruxellesThe powers of the future European Public Prosecutor’s Office (EPPO) should be clearer and the EPPO should make sure that defence rights are properly protected in all its activities, said the Civil Liberties Committee in a resolution passed on Thursday.The non-legislative text, approved by 34 votes to 7 with 1 abstention, sets Parliament’s priorities and red lines for giving its consent to the EPPO proposal when the moment comes.The protection of the EU budget against fraud can be better achieved at EU level, MEPs underline. However, they urge member states to clarify the EU prosecutor’s powers and the relationship between the EPPO and other EU bodies, such as Eurojust and OLAF.The committee text also points out that the EPPO’s competences should only be extended to offences other than those affecting the EU’s financial interests under three conditions:when the conduct simultaneously constitutes a crime affecting the EU’s financial interests and other offences;when the offences affecting the EU’s financial interests are predominant; and when the other crimes would be barred from further punishment if they were not prosecuted and brought to judgement together with the offences affecting the EU’s financial interests.The EPPO should ensure a high protection of defence rights in all its activities, MEPs point out, adding that EU minimum standards for procedural rights in criminal procedures should be respected in all the EPPO’s activities.In order to receive Parliament’s consent, the EPPO proposal should include a hierarchy of binding criteria to decide which court exerts jurisdiction over the different cases.
